About Regulations on procedure for import to customs area of the Customs union of products (goods) concerning which mandatory requirements within the Customs union are established

According to article 3 of the Agreement on the Eurasian economic commission of November 18, 2011 and article 13 of the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 the Board of the Eurasian economic commission solved:

1. Approve the enclosed Regulations on procedure for import to customs area of the Customs union of products (goods) concerning which mandatory requirements within the Customs union are established.

2. Determine that import to customs area of the Customs union of products (goods) concerning which technical regulations of the Customs union provide assessment of conformity in the form of state registration is performed according to the Decision of the Commission of the Customs union of May 28, 2010 N 299 "About application of sanitary measures in custom union".

3. Recognize invalid:

the paragraph the fifth Item 1 and Item 6 of the Decision of the Commission of the Customs union of June 18, 2010 N 319 "About technical regulation in custom union";

paragraph two of the Decision of the Commission of the Customs union of December 8, 2010 N 491 "About modification of regulatory legal acts of the Commission of the Customs union in the field of technical regulation".

4. This Decision becomes effective after 30 calendar days from the date of its official publication.

Regulations on procedure for import to customs area of the Customs union of products (goods) concerning which mandatory requirements within the Customs union are established

1. This Provision is developed in agreement performance about the Eurasian economic commission of November 18, 2011, the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 and the Agreement on the product circulation which is subject to obligatory assessment (confirmation) of compliance on customs area of the Customs union of December 11, 2009.

2. Belong products (goods) which to products (goods) imported (imported) on customs area of the Customs union concerning which in case of its customs declaring along with the customs declaration to customs authorities the documents certifying compliance of such products (goods) to mandatory requirements, or data on such documents are subject to representation:

a) it is included in the Single list of products concerning which mandatory requirements within the Customs union, approved by the Decision of the Commission of the Customs union of January 28, 2011 N 526 "About the Single list of products concerning which mandatory requirements within the Customs union are established", and concerning which the legislation of state members of the Customs union (further - state members) establishes mandatory requirements are established;

b) it is included in the Single list of products which are subject to obligatory assessment (confirmation) of compliance within the Customs union with issue of single documents, approved by the Decision of the Commission of the Customs union of April 7, 2011 N 620 "About new edition of the Single list of products which are subject to obligatory assessment (confirmation) of compliance within the Customs union with issue of single documents approved by the Decision of the Commission of the Customs union of June 18, 2010 N 319" (dalee-Ediny the list);

c) it is included in lists of products concerning which submission of the customs declaration is followed by submission of the document on assessment (confirmation) of compliance to requirements of technical regulations of the Customs union.

3. Treat the documents certifying compliance of products (goods) to mandatory requirements:

a) the document on assessment (confirmation) of compliance provided by technical regulations of the Customs union;

b) the certificate of conformity or the declaration of conformity of the Customs union which are drawn up in single form on products (goods) included in the Single list;

c) the certificate of conformity, the declaration of conformity, stipulated by the legislation state member in the territory of which products (goods) are located under customs procedures;

d) other documents, stipulated by the legislation state member in the territory of which products (goods) are located under customs procedures.

4. The documents certifying compliance of products (goods) to mandatory requirements or data on such documents are represented to customs authorities when placing products (goods) under customs procedures:

a) release for internal consumption, including the customs procedure of release for internal consumption declared in case of completion of other customs procedures, except for products (goods) imported (imported):

as tests and samples for carrying out researches and testing on condition of submission to customs authority of the copy of the contract with accredited body on certifications (accredited test laboratory (center)) or the letters of such accredited body on certification (accredited test laboratory (center)) confirming quantity, necessary for these purposes (weight and amount) of the imported (imported) products (goods);

the manufacturer or the authorized representative of the manufacturer as spare parts for servicing and repair of the finished products which are earlier imported on customs area of the Customs union concerning which compliance to mandatory requirements, on condition of submission to customs authorities of copies of documents on assessment (confirmation) of compliance of such finished products is confirmed;

as the completing goods or raw materials (materials) to products released in the territory of state member on which their room under customs procedure of release for internal consumption is performed;

to diplomatic representations, consular establishments, other official representations of foreign states, interstate and intergovernmental organizations, on condition of submission to customs authority of their motivated address about consumption (use) exclusive such representations, organizations, the organizations;

as humanitarian or technical assistance;
