According to Item 3 of article 84 of the Law of the Republic of Kazakhstan of February 13, 2012 "About special state bodies of the Republic of Kazakhstan" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of forming and provision by special state bodies of the Republic of Kazakhstan of office dwellings.

2. This resolution becomes effective since January 1, 2013 and is subject to official publication.

Rules of forming and provision by special state bodies of the Republic of Kazakhstan of office dwellings

Chapter 1. General provisions

1. These rules of forming and provision by special state bodies of the Republic of Kazakhstan of office dwellings (further – Rules) are developed according to the laws of the Republic of Kazakhstan of April 16, 1997 "About the housing relations" (further – the Law) and of February 13, 2012 "About special state bodies of the Republic of Kazakhstan".

2. Action of these rules extends to the dwellings belonging on the property right to the state, being on the right of operational management of special state bodies of the Republic of Kazakhstan (further – SGO), and also to the workers including accepted within single cross-industry standard rates of number of the workers providing maintenance and functioning of the state bodies provided by the subitem 40) of Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015.

3. The office dwelling of SGO is the dwelling with particular legal regime provided from housing stock of SGO and intended for settling of employees, military personnel and employees of SGO, and also members of their families for accomplishment of service duties by them.

4. Providing bodies of homeland security with the office dwelling of the military personnel is performed according to the Rules of providing the military personnel with the office dwelling, calculations of the size, appointment, recalculation, implementation, the termination, suspension and renewal of housing payments approved by the Government of the Republic of Kazakhstan.

Chapter 2. Forming of the office dwelling of SGO

5. Forming of office dwellings of SGO is performed at the expense of the dwellings which are on the right of operational management of SGO.

6. Office dwellings of SGO consist from rooms to hostels, apartments, individual apartment houses and dwellings which are in the territory of military camps, frontier posts and other closed objects.

7. Account of office dwellings is kept by responsible structural divisions of SGO organizations. Accounting of employees, military personnel and employees of SGO and members of their families needing the dwelling is performed by responsible structural divisions of SGO organizations to which functions on accounting of office dwellings are assigned.

Chapter 3. Procedure for provision of the office dwelling

8. The office dwelling for accomplishment of the obligations connected with nature of their employment relationships by them according to the decision of the housing commission of SGO organization is provided to employees, military personnel and employees of SGO.

9. Office dwellings in hostels of housing stock of public institutions of bodies of homeland security in this settlement are provided for service to the faces recognized needing the dwelling and consisting in personnel of bodies of homeland security.

10. Office dwellings of SGO are provided to employees, military personnel and employees of SGO according to the regulations established by the Law.

11. Office dwellings are provided to the employees needing the dwelling, the military personnel and employees of SGO staying on the registry according to the procedure of priority, on registration date of the official report (statement) with all necessary documents specified in Item 12 of these rules.

12. For registration of SGO needing the dwelling employees, the military personnel and workers represent to the housing commission of SGO organization:

1) the official report (statement) addressed to the chairman of the housing commission of public institution of SGO for registration needing the dwelling;

2) the copy of identity documents of the employee, the serviceman, the employee of SGO and members of his family, certificates of birth of children, the conclusion (termination) of scrap, in the presence of family;

3) the reference from personnel division of SGO with indication of the information about family composition received within ten calendar days about day of registration of the official report (statement);

4) the certificate of judicial authorities of lack (availability) of real estate (on the territory of the Republic of Kazakhstan) received on family composition within ten calendar days about day of registration of the official report (statement);

5) the certificate of local executive body of availability or lack of the dwelling from municipal housing stock received on family composition within ten calendar days about day of registration of the official report (statement);

6) the reference of the spouse (spouse) with data on receipt of the dwelling from the state housing stock received within a month about day of registration of the official report in case the spouse (spouse) is the employee of public institution or state company.
