About approval of the Procedure for conducting metrological examination of drafts of technical regulations, other regulatory legal acts containing requirements for ensuring unity of measurements

(as amended of the Order of the Government of the Kyrgyz Republic of 25.03.2015 No. 153)

According to the Law of the Kyrgyz Republic "About ensuring unity of measurements" the Government of the Kyrgyz Republic decides:

1. Approve the Procedure for conducting metrological examination of drafts of technical regulations, other regulatory legal acts containing requirements for ensuring unity of measurements according to appendix.

2. This resolution becomes effective from the date of official publication.

Procedure for conducting metrological examination of drafts of technical regulations, other regulatory legal acts containing requirements for ensuring unity of measurements

1. General provisions

1. Metrological examination - the analysis and estimation of correctness of application of the metrological requirements, rules and regulations first of all connected with unity and accuracy of measurements.

2. Drafts of technical regulations, other regulatory legal acts which contain mandatory requirements on ensuring unity of the measurements falling within the scope of state regulation on ensuring unity of measurements according to the Law of the Kyrgyz Republic "About ensuring unity of measurements" are subject to obligatory metrological examination.

3. Metrological examination is obligatory stage of creation of drafts of technical regulations, other regulatory legal acts which contain requirements for ensuring unity of measurements.

4. When conducting metrological examination the analysis of results of project development of the technical regulation, other regulatory legal acts which contain requirements for ensuring unity of measurements, on compliance to the international, national standards, regulations and rules is carried out.

5. Metrological expertize is carried out by national authority on metrology.

6. Main objective of metrological examination: assessment of conformity of the metrological requirements established in drafts of technical regulations, regulatory legal acts which contain requirements for ensuring unity of measurements, the requirements containing in interstate and national regulating legal documents on metrology and also ensuring efficiency of metrological support, accomplishment of general and specific requirements to metrological support with the most rational methods and means.

2. Procedure for conducting metrological examination

7. The subject having rule-making initiative can be the customer of metrological examination of drafts of technical regulations, regulatory legal acts which contain requirements for ensuring unity of measurements.

8. For metrological examination represent the draft of the technical regulation, regulatory legal act containing requirements for ensuring unity of measurements with the cover letter addressed to the head of authorized body on metrology which then arrives in the relevant department of national authority of metrology.

9. When conducting metrological examination estimate:

a) observance of metrological requirements to products, processes (methods) of production, construction, installation, adjustment, storage, transportation, realization, operation, utilization according to the existing documents on standardization and metrology on these types of activity;

b) rationality of the nomenclature of the measured parameters according to the existing documents on standardization and the regulating documents regulating metrological rules and regulations;

c) completeness and correctness of requirements to the accuracy of measuring instruments according to the existing documents on standardization and the regulating documents regulating metrological rules and regulations;

d) value of the actual accuracy of measurements required according to the existing documents on standardization and the regulating documents regulating metrological rules and regulations;

e) possibility of effective metrological servicing of the chosen measuring instruments according to the existing documents on standardization and the regulating documents regulating metrological rules and regulations;

e) correctness of the use of metrological terms and concepts, names, designations, determinations and rules of application of units of physical quantities according to the existing documents on standardization and the regulating documents regulating metrological rules and regulations and the international documents on metrology.

10. Duration of conducting metrological examination shall not exceed 10 days from the date of receipt of the draft of the technical regulation, regulatory legal act which contain requirements for ensuring unity of measurements, for examination.

3. Registration of results of metrological examination

11. Results of metrological examination are drawn up in the form of the conclusion in form according to appendix 1 to this Provision.

12. The conclusion by results of metrological examination is signed by person (persons) who was carrying out metrological examination (further - the expert-metrologist).

13. The conclusion is drawn up in duplicate. The first copy of the conclusion is transferred to the customer (applicant), the second remains in the division which was carrying out metrological expertize.

14. In the presence of the notes requiring considerable conversion of drafts of technical regulations, regulatory legal acts which contain requirements for ensuring unity of measurements return to completion with the subsequent repeated representation for metrological examination.

15. Accounting of drafts of technical regulations, other regulatory legal acts which contain mandatory requirements on ensuring unity of the measurements which passed the metrological examination are drawn up in the magazine in the form specified in appendix 2 to this Provision.

16. Disagreements between the developer and the expert-metrologist are permitted by joint discussion of question between concerned parties.

17. The expert-metrologist bears responsibility for completeness, correctness and technical justification of the made notes and offers.

18. The expert-metrologist has the right to request from the customer (applicant) of explanation on the questions arising when conducting metrological examination, and if necessary - additional help data.
