The government of the Russian Federation decides:

1. Approve the enclosed Regulations on compensation of the procedural costs connected with criminal trial, costs in connection with consideration of the case by Arbitration Court, civil case, administrative case, and also expenses in connection with fulfillment of requirements of the Constitutional Court of the Russian Federation.

2. Determine that increase (indexation) in the amount of compensation of the procedural costs connected with criminal trial, costs in connection with consideration of the case by Arbitration Court, civil or administrative case and also expenses in connection with fulfillment of requirements of the Constitutional Court of the Russian Federation is made annually taking into account the rate of inflation (consumer prices) according to the Federal Law on the federal budget for the corresponding financial year and planning period in time determined by the Government of the Russian Federation.

3. To the Ministry of Labour and Social Protection of the Russian Federation with participation of other interested federal executive bodies to make offers on increase (indexation) in the amount of cost recovery and expenses, the stipulated in Item 2 presents of the resolution, as compensation to the victim who do not have the permanent salary, the witness, their legal representatives, and also witnesses for their derivation from regular occupations.

4. Financial provision of the payment commitments connected with implementation of this resolution is performed within the budgetary appropriations provided in the federal budget for the corresponding financial year on content of the courts and state bodies given authority on production of inquiry and pretrial investigation.

5. Recognize invalid acts of Council of Ministers of RSFSR and the Government of the Russian Federation according to the list according to appendix.

6. This resolution becomes effective since January 1, 2013.

Regulations on compensation of the procedural costs connected with criminal trial, costs in connection with consideration of the case by Arbitration Court, civil case, administrative case, and also expenses in connection with fulfillment of requirements of the Constitutional court of the Russian Federation

1. This Provision establishes:

a) procedure and the amount of compensation of the procedural costs provided by Items 1 - 9 parts two of Article 131 of the Code of penal procedure of the Russian Federation connected with criminal trial, except for the sizes of the procedural costs provided by Items 2 and 8 of part two of the specified Article;

b) procedure and the amount of compensation of the court costs incurred by court, payments of sums of money to translators, and also payment procedure of sums of money to witnesses and return to the parties of the unspent sums of money granted by them on account of the forthcoming court costs in connection with consideration:

put Arbitration Court, - according to part 4 of Article 107 of the Arbitral Procedure Code of the Russian Federation;

civil case, - according to Article part two 95, Article part four 96, part two of Article 97 and part five of article 103 of the Civil Procedure Code of the Russian Federation;

administrative case, - according to part 2 Articles 108, part 4 Articles 109, part 2 Articles 110, part 4 of article 114 of the Code of administrative legal proceedings of the Russian Federation;

c) procedure for compensation to persons and the organizations at the expense of means of the federal budget (except for state bodies and the organizations) expenses in connection with accomplishment of requirements of the Constitutional Court of the Russian Federation by them according to part two of article 50 of the Federal constitutional Law "About the Constitutional Court of the Russian Federation".

2. Journey to production site of legal proceedings and back to the residence, works or to the place of temporary stay is paid to the victim, the witness, their legal representatives, the expert, the specialist, the translator, witnesses, and also the lawyer participating in criminal trial to destination of the investigator, the investigator or court (further - advance holders), not over the fare:
