1. Approve the enclosed Rules of consideration and selection of target transfers on development.

2. Recognize invalid:

1) the order of the Government of the Republic of Kazakhstan of January 29, 2011 No. 40 "About approval of Rules of allocation of target transfers on development";

2) the order of the Government of the Republic of Kazakhstan of May 8, 2012 No. 595 "About modification of the order of the Government of the Republic of Kazakhstan of January 29, 2011 No. 40 "About approval of Rules of allocation of target transfers on development".

3. This resolution becomes effective from the date of signing and is subject to official publication.

Rules of consideration and selection of target transfers on development

1. General provisions

1. These rules of consideration and selection of target transfers on development (further - Rules) are developed according to Item 8 of Article 46 of the Budget code of the Republic of Kazakhstan of December 4, 2008 and determine procedure for consideration and selection of the target transfers on development transferred from the higher budget to subordinate budgets.

2. Target transfers on development are the transfers transferred by higher budgets in subordinate within the amounts approved in republican or regional budgets for implementation of local budget development programs.

Target transfers are allocated to subordinate budgets for development in case of achievement of direct results of the local budget investment projects determined in agreements on results on the target transfers on development allocated in the previous financial year. Administrators of local budget programs develop and create the list of local budget investments (further - MBI) by budget investments (objects) according to the procedure, the established Rules of consideration, selection, monitoring and assessment of implementation of the budget investment projects approved by the order of the Government of the Republic of Kazakhstan of April 17, 2009 No. 545, and requirements to content, procedure and terms of development of financial and economic reasons, and also procedure for selection of the budget investments planned to realization by means of participation of the state in the authorized capital of legal entities, approved by the order of the Minister of Economic Development and Trade of the Republic of Kazakhstan of July 22, 2010 No. 126, and send to the relevant local authorized body on state planning.

5. Local authorized body on state planning:

1) is considered by the list of MBI of administrators of local budget programs by budget investments (objects);

2) is prepared by the economic conclusion and constitutes the list of MBI by budget investments (objects).

In case of creation of the list of MBI the relevant local authorized body together with administrators of local budget programs determines sources of financing of MBI by state planning.

At the expense of target transfers on development from the higher budget MBI corresponding to the Strategic plan of development of the Republic of Kazakhstan till 2020, to the Forecast scheme of territorial and spatial development of the country, strategic directions and social and economic development of regions, strategic plans of state bodies, the state and industry programs, development programs of the territories are implemented.

Target transfers on development are allocated for construction, reconstruction:

1) objects of education; priority objects of formation of local value according to technique of determination of need for objects of education and forming of the list of priority investment projects;

2) health care facilities; priority health care facilities of local value according to technique of determination of need for health care facilities and forming of the list of priority investment projects;

3) medico-social organizations: psychoneurological medico-social organizations, the rehabilitation centers for disabled people, the centers of rehabilitation and adaptation of handicapped children;

4) gas pipeline branches of high pressure from trunk gas pipelines and the bringing intersettlement gas pipelines of high pressure with construction of the automated stations of distribution of gas;

5) rent (municipal) housing according to the State (industry) program;

6) highways of regional and district value, streets of the cities and settlements;

7) water supply systems and water disposal of the cities and rural settlements;

8) objects for engineering protection of the population, objects and the territories from natural natural disasters;

9) objects of culture, sport and tourism, improvement, environmental protection, agro-industrial complex, forest, fishery, municipal, water economy, transport, engineering and communication, industrial and innovative infrastructure, heat power system, public order and safety of district, regional value and cities of Astana and Almaty.

6. The local executive body of area, city of republican value, the capital, area (city of regional value) for determination of the amounts of target transfers on development no later than March 15 of the current financial year represents to the relevant central state body or executive body financed from the regional budget:

1) the request with indication of the list of MBI by objects and expense amount on them;

2) the feasibility statement with the conclusion of state examination (in case of availability) according to the local budget investment projects requiring development of the feasibility study;

3) the design estimates with the conclusion of state examination (in case of availability) according to local budget investment projects;

4) the order of the state body administrator of programs or authorized state body for architecture, town planning and construction on the feasibility study or the design and estimate documentation (in case of availability);

5) the investment offer on the local budget investment projects which are not requiring development of the feasibility statement;
