RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About approval of the Regulations on procedure for providing and cancellation of the check mode in the territories of evacuation area (alienation), zone of first-priority settling out and zone of the subsequent settling out from which the population is settled out, and recognition voided some resolutions of Council of Ministers of the Republic of Belarus and their separate structural elements

According to the paragraph the sixth Article 12 and article 18 of the Law of the Republic of Belarus of May 26, 2012 No. 385-Z "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for providing and cancellation of the check mode in the territories of evacuation area (alienation), zone of first-priority settling out and zone of the subsequent settling out from which the population is settled out it (is applied).

2. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of September 13, 2007 No. 1165 "About modification and amendments in the resolution of Council of Ministers of the Republic of Belarus of February 28, 2006 No. 299" (The national register of legal acts of the Republic of Belarus, 2007, No. 226, 5/25789);

subitem 1.10 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of November 4, 2007 No. 1452 "About modification and amendments in some resolutions of Council of Ministers of the Republic of Belarus concerning activities of law-enforcement bodies of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2007, No. 274, 5/26094);

subitem 1.36 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of December 23, 2008 No. 2010 "About modification and amendments in some resolutions of Council of Ministers of the Republic of Belarus concerning documentation of the population of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2009, No. 14, 5/29066);

3. This resolution becomes effective since December 7, 2012.

Regulations on procedure for providing and cancellation of the check mode in the territories of evacuation area (alienation), zone of first-priority settling out and zone of the subsequent settling out from which the population is settled out

Chapter 1. General provisions

1. This Provision determines procedure for establishment, cancellation and providing the check mode in the territories of zones of radioactive pollution from which the population, stay of physical persons, individual entrepreneurs, workers of legal entities, entrance of vehicles and other equipment, export of property is settled out.

2. The check mode is set in the territories of evacuation area (alienation), zone of first-priority settling out and zone of the subsequent settling out from which the population is settled out (further if other is not determined, – the territories in which the check mode is set), for the purpose of prevention of unauthorized stay of citizens, entrance of all types of vehicles and other equipment (further – vehicles), export of property without properly the processed documents, and also providing sanitary and fire-proof condition of the territories on which the check mode is set.

3. Borders of the territories on which the check mode is set of the road for transit without omissions are displayed on cards of the territories on which the check mode is set.

4. The Gomel and Mogilev regional executive committees provide development and the edition of cards of the territories on which the check mode, at least once in five years is set.

5. Cards of the territories on which the check mode is set are placed for open acquaintance in district executive committees, and also in electronic form on the websites of district executive committees, Gomel and Mogilev regional executive committees.

6. The check mode will be organized Gomel and Mogilev by regional executive committees and provided with law-enforcement bodies and the public nature protection research establishment "Polesia National Radiation and Ecological Park" (further – organization) in its territory. For this purpose the specified bodies and the organizations perform patrol, means of remote detection, photo and video fixing are used.

Functions on the organization of the check mode in the Gomel and Mogilev regional executive committees are implemented by specially created structural divisions.

7. For providing the check mode with organization stationary and portable check-points are created (further – check points), in need of the check point can be created by law-enforcement bodies.

At the check point magazines of citizens, vehicles, the exported (imported) property, acceptance delivery of watches, check of work of the check point are recorded.

8. Dislocation of stationary, portable check points and routes of patrol of law-enforcement bodies annually no later than December 10 of the year preceding planned are determined by territorial authorities of internal affairs in coordination with district executive committees.

9. Dislocation of stationary, portable check points and routes of patrol of security service of organization at least once in five years are determined by his director in coordination with district executive committees and the Ministry of Natural Resources and Environmental Protection.
