About approval of the Regulations on procedure for issue of permissions to burial of the radioactive waste formed in connection with catastrophic crash on the Chernobyl NPP, and also it is lower than the level of other waste, products, materials and other substances contaminated by radionuclides as a result of catastrophic crash on the Chernobyl NPP, established by regulatory legal acts, including technical regulatory legal acts, for radioactive waste

Based on part one of article 32 of the Law of the Republic of Belarus of May 26, 2012 No. 385-Z "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for issue of permissions to burial of the radioactive waste formed in connection with catastrophic crash on the Chernobyl NPP, and also it is lower than the level of other waste, products, materials and other substances contaminated by radionuclides as a result of catastrophic crash on the Chernobyl NPP, established by regulatory legal acts, including technical regulatory legal acts, for radioactive waste it (is applied).

2. This resolution becomes effective since December 7, 2012.

1. This Provision establishes procedure for issue of permissions to burial by the specialized organizations of the radioactive waste formed in connection with catastrophic crash on the Chernobyl NPP (further – radioactive waste), and also it is lower than the level of other waste, products, materials and other substances contaminated by radionuclides as a result of catastrophic crash on the Chernobyl NPP, established by regulatory legal acts, including technical regulatory legal acts, for radioactive waste (further – other waste), on subjects of the treatment of radioactive waste and subjects of the address with other otkhodami*.

* For the purposes of this provision the terms "subjects of the treatment of radioactive waste", "subjects of the address with other waste" in the values determined respectively in parts one and the second article 33 of the Law of the Republic of Belarus "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" are used.

2. The specialized organizations authorized on implementation of burial of radioactive waste on subjects of the treatment of radioactive waste, burials of other waste on subjects of the address with other waste in the Gomel and Mogilev regions are the specialized organizations having special permissions (licenses) for the right of implementation of activities in the field of use of atomic energy and sources of ionizing radiation subordinated to regional executive committees (further – the specialized organizations).

3. Issue of permission to burial of radioactive waste on subjects of the treatment of radioactive waste, other waste on subjects of the address with other waste (further – permission to waste disposal) is performed by the Ministry of Emergency Situations (Department on nuclear and radiation safety) (further – body of issue of permission).

4. For receipt of permission to waste disposal the individual entrepreneur or the legal entity irrespective of patterns of ownership submits in body of issue of permission the application in form according to appendix.

5. The decision on refusal in adoption of the statement is made according to the procedure and on the bases provided in article 17 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures".

6. The body of issue of permission shall within 30 calendar days from the date of receipt of the statement:

request in the organizations performing works on measurement of radioactive pollution of waste and (or) performing preparation of the conclusion about their bacteriological safety (concerning waste of animal origin), the relevant information;

determine connection of radioactive pollution of waste with catastrophic crash on the Chernobyl NPP;

consider the possibility and terms of waste disposal by the specialized organizations taking into account features of subjects of the treatment of radioactive waste and subjects of the address with other waste;

agree on possibility of issue of permission to waste disposal with the Gomel or Mogilev regional executive committee;

make the decision on issue of permission to waste disposal or on refusal in its issue and in writing to inform on it the applicant.

7. The notification on the made decision body of issue of permission is issued or goes to the applicant according to the procedure, provided in article 27 of the Law of the Republic of Belarus "About bases of ministerial procedures".

8. The decision on refusal to the applicant in issue of permission to waste disposal is made according to the procedure and on the bases provided in articles 25 and 26 of the Law of the Republic of Belarus "About bases of ministerial procedures".

9. In case of decision making about issue of permission to waste disposal the body of issue of permission sends to the applicant such permission and at the same time informs the Gomel or Mogilev regional executive committee on the made decision.

10. In case of decision making about refusal in issue of permission to waste disposal the body of issue of permission sends to the applicant the written answer with reasons for causes of failure.

11. In case of burial of radioactive waste and other waste which formation is connected with holding actions for improvement of radiation situation in the territories of radioactive pollution which are carried out according to the Law of the Republic of Belarus "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" of permission to waste disposal are issued to the Gomel and Mogilev regional executive committees based on the programs of actions for liquidation, burial of objects, content and optimization of system of subjects of the treatment of radioactive waste, and also other waste, products, materials and other substances submitted for approval in body of issue of permission on which burial of such waste was performed or performed, for the next year (further – the program of actions).
