1. Approve enclosed:

1) Rules of subsidizing of rate of remuneration on the credits / to leasing transactions of banks / leasing companies provided to subjects of private entrepreneurship, and also provision of support on development of production (industrial) infrastructure within the Program;

2) Rules of provision of state grants on creation of new productions within the Program.

2. To impose control of execution of this resolution on the Ministry of Economic Development and Trade of the Republic of Kazakhstan.

3. This resolution becomes effective after ten calendar days after the first official publication.

Rules of subsidizing of rate of remuneration on the credits / to leasing transactions of banks / leasing companies provided to subjects of private entrepreneurship, and also provision of support on development of production (industrial) infrastructure within the Program

1. General provisions

1. These rules of subsidizing of rate of remuneration on the credits / to leasing transactions of banks / leasing companies provided to subjects of private entrepreneurship, and also provision of support on development of production (industrial) infrastructure within the Program determine procedure for subsidizing of rate of remuneration by the credits / to leasing transactions of banks / leasing companies provided to subjects of private entrepreneurship within the Development program of monotowns for 2012 - 2020 approved by the order of the Government of the Republic of Kazakhstan of May 24, 2012 No. 683 (further - the Program).

2. Subsidizing of rate of remuneration on the credits / to leasing transactions of banks / leasing companies will be performed on the new credits / to leasing transactions of the subjects of private entrepreneurship (further - the entrepreneur) performing activities in monotowns with low and average potential according to the list of the monotowns of the Republic of Kazakhstan specified in appendix 1 to the Program in any sectors of economy, except as specified, established by these rules.

3. Subsidizing is performed on the new credits / to leasing transactions of banks / leasing companies issued for implementation of new investment projects, and also the projects directed to upgrade and expansion of production in any sectors of economy.

Subsidizing cannot be performed on the new credits / to leasing transactions issued (issued) on replenishment of current assets, except as specified, when financing of current assets is performed within credit/leasing on acquisition and/or upgrade of fixed assets and/or expansion of production, but no more than 30% of the credit/leasing amount.

The credits / leasing transactions issued by banks / leasing companies with July 1, 2012 belong to the new credits / agreements of financial leasing.

4. The credits / leasing transactions directed to refinancing of the loans/agreements of financial leasing received not earlier than July 1, 2012, the Programs corresponding to criteria are subject to subsidizing.

5. The state and other bodies and the organizations responsible for goal achievement, tasks, indicators of results and the terms used in Rules:

1) bank - the bank of the second level which signed the agreement on cooperation within subsidizing of rate of remuneration on the credits / to leasing transactions of banks / leasing companies provided to the subjects of private entrepreneurship performing the activities in monotowns (further - the agreement on cooperation);

2) bank - the payment agent - authorized bank of leasing company which shall be approved with the financial agent and perform functions on maintaining the special checking account of the financial agent intended for transfer and write-off of subsidies under agreements of financial leasing of leasing companies;

3) the agreement of subsidizing - the agreement signed between the financial agent, bank / leasing company and the entrepreneur under the terms of whom the financial agent partially subsidizes remuneration rate under the agreement of financial leasing signed by the entrepreneur with bank / leasing company;

4) the agreement of bank loan - the written agreement signed between the entrepreneur, bank under the terms of which bank grant the loan to the entrepreneur. The agreement on opening of credit line also belongs to the agreement of bank loan;
