RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About approval of the Regulations on procedure and the size of employee benefit of the Investigative Committee of compensation for use of the vehicles belonging to them in the office purposes

Based on article 30 of the Law of the Republic of Belarus of July 13, 2012 "About the Investigative Committee of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure and the size of employee benefit of the Investigative Committee of compensation for use of the vehicles belonging to them in the office purposes.

2. This resolution becomes effective from the date of its official publication.

Regulations on procedure and the size of employee benefit of the Investigative Committee of compensation for use of the vehicles belonging to them in the office purposes

1. This Provision establishes procedure and the size of employee benefit of the Investigative Committee (further, unless otherwise specified, - employees) compensations for use of the vehicles belonging to them in the office purposes (further - compensation).

2. The employees using the vehicles belonging to them in the office purposes (further - vehicles), receive compensation of cost of the spent fuels and lubricants in terms of money. Calculation of compensation is made according to Items 7 and 8 of this provision.

Other expenses connected with use of vehicles (depreciation (depreciation), repair, obligatory civil liability insurance of owners of vehicles, losses for the harm done to the vehicle, losses for the harm done by the vehicle, and another), employees bear at own expense.

3. Compensation payment to employees is made in cases if their service according to service duties is connected with permanent (daily) trips on the office vehicle, except for office vehicles of operational assignment and special cars, and in structural division of division of the Investigative Committee (daleestrukturny division) in which employees serve, the number of office vehicles are less, than is established by regulations of polozhennost of vehicles, or the office vehicle assigned to structural division in a row is not used more than 30 calendar days (is under repair, process of write-off and other).

In the cases specified in part one of this Item, compensation can be paid to several employees of the same structural division according to regulations of polozhennost of vehicles.

4. For receipt of compensation the employee submits respectively addressed to the Chairman of the Investigative Committee, the head of department of the Investigative Committee on area, Minsk the written official report with reasons for need of use of the vehicle.

The official report of the employee of central office of the Investigative Committee, management of the Investigative Committee on area, Minsk the immediate superior, and the official report of the employee of district (interdistrict), city, district department of the Investigative Committee in the city - the chief of this department approves it.

5. After consideration of the official report by the head specified in part one of item 4 of this provision, and decision making about compensation employee benefit the usage agreement of the individual transport in the office purposes (further - the agreement) is signed with the employee in which including are specified:

the name of the used vehicle;

certificate number about registration (log book) of the vehicle;

obligation according to central office of the Investigative Committee, management of the Investigative Committee on area, Minsk on compensation payment;

the duration of the agreement taking into account Item 3 this provision.

The copy of the registration certificate (log book) of the vehicle certified in accordance with the established procedure is attached to the agreement.

6. Expenses on compensation payment to employees are made within the planned assignments provided according to central office of the Investigative Committee, managements of the Investigative Committee on areas and Minsk on payment of transport services in expense budget at the expense of means of the republican budget.

7. If compensation is paid to several employees of the same structural division according to regulations of polozhennost of vehicles, the amount of compensation for each of them is determined in proportion to the number of employees by formula

where RPR. with - the amount of compensation for the employee of structural division;

Ktr - the number of vehicles which do not complete according to regulations of polozhennost of vehicles structural division where employees, and also the office vehicles which are not used (being under repair, process of write-off and other) in structural division serve;

The RPR - the extreme amount of compensation according to appendix to this Provision;

Ks - the number of employees of the same structural division to which compensation is paid.

If the amount of compensation determined by this formula exceeds the size established in appendix to limiting this Provision, then the amount of compensation to each employee of structural division is accepted equal to the extreme size.

8. Compensation is calculated in proportion to the number of calendar days of month during which the employee used the vehicle, proceeding from the extreme amount of compensation or the size determined according to Item 7 of this provision on the date of payment and is paid to employees in the month following for reporting along with payment of cash allowance.

For the period findings of the employee on leave, official journey, absence on service owing to temporary disability, and also in case of non-use of the vehicle in the office purposes for other reasons compensation is not paid.

The number of calendar days of month in which the vehicle was used is specified in the act which form affirms the Chairman of the Investigative Committee. This statement is drawn up and signed by the employee.

The statement which is drawn up and signed by the employee of central office of the Investigative Committee, management of the Investigative Committee on area, Minsk the immediate superior and constituted and signed by the employee of district (interdistrict), city, district department of the Investigative Committee in the city - the chief of this department approves it.

The act respectively the Chairman of the Investigative Committee, the head of department of the Investigative Committee on area, Minsk affirms.

9. The basis for compensation payment to employees is respectively the order of the Chairman of the Investigative Committee, the head of department of the Investigative Committee on area, Minsk.

10. The employees who provided false information on use of vehicles bear responsibility according to legal acts.

11. The service employees making the decision and approving documents on payment of compensation according to this Provision bear the personal responsibility for justification of its payment.
