Procedure for consideration of the applications (materials) about violation of general competition rules in the cross-border markets

I. General provisions

1. This Procedure is developed according to Items 10, 11 and 13.1 Protocols on the general principles and competition rules (appendix No. 19 to the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement)) and is applied by the Eurasian economic commission (further - the Commission) in case of consideration of the applications (materials) about availability of signs of violation of general competition rules in the cross-border markets in the territories of 2 and more state members of the Eurasian Economic Union, stipulated in Clause 76 Agreements (further respectively - the cross-border markets, state members), and also in case of issue of the warning of need of the termination of actions (failure to act) which contain signs of violation of general competition rules, and (or) about elimination of the reasons and conditions promoting emergence of signs of such violation and about taking measures to elimination of effects of such actions (failure to act) (further - the prevention).

2. In this Procedure the concepts determined in Item 2 of the Protocol on the general principles and competition rules (appendix No. 19 to the Agreement) are used.

3. Statements for availability of signs of abuse of regulations of the competition (further - applications) are submitted to the Commission by legal and (or) physical persons.
