ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of Regulations of processing by ionizing radiation of products of different origin

1. Approve Regulations of processing by ionizing radiation of products of different origin it (is applied).

2. Approve processing method by ionizing radiation of foodstuff and ingredients of different origin as the alternative, sample method which does not replace without fail the existing processing methods applied in different industries of national economy.

3. Ionizing radiation of foodstuff and ingredients of different origin to perform the state sanitary inspection behind processing methods to the Ministry of Health through the National center of public health.

4. Ionizing radiation of foodstuff and ingredients of different origin to perform the state control of safety of methods of processing to the Ministry of the environment through National agency on regulation of nuclear and radiological activities.

5. The additional list of foodstuff and ingredients of different origin which can be processed by ionizing radiation established by the Ministry of Agriculture and the food industry and National committee Codex Alimentarius, will be approved by the Government.

6. To provide to the Ministry of Health, the Ministry of Agriculture and the food industry by means of the publication of joint departmental acts the admission on the market of the foodstuff and ingredients of different origin which are subject to processing by ionizing radiation according to the lists approved by the Government.

7. To perform accomplishment of provisions of this Resolution for the account and within the financial resources which are annually provided in budgets of the involved organizations and from other sources which do not contradict the legislation.

8. Implementation of the administrative acts necessary for permission of trade and the use of the foodstuff processed by ionizing radiation to assign to the Government.

9. This Resolution becomes effective after 90 days from the date of publication in the Official monitor of the Republic of Moldova.

Regulations of processing by the ionizing radiation of products of different origin

The regulations of processing by the ionizing radiation of products of different origin (further - Regulations) apply partially the Directive 1999/2/EC of the European Parliament and Council of February 22, 1999 about approximation of laws of state members to food and the food ingredients processed by ionizing radiation, L66 published in the Official magazine of the European Union of March 13, 1999 and also shift the Directive 1999/3/EC of the European Parliament and Council of February 22, 1999 about determination of the list of the food and ingredients processed by ionizing radiation, L66 published in the Official magazine of the European Union of March 13, 1999.

CHAPTER I GENERAL PROVISIONS

1. The purpose of these Regulations - determination of the main specific requirements for processing by ionizing radiation of food, food ingredients, and also ensuring their safety.

2. The principles and general procedures necessary for carrying out activities for processing by ionizing radiation of food and food ingredients are reflected in these Regulations.

3. Provisions of these Regulations extend to production processes, markings, placements in the market, import and export of food and food ingredients which are processed by ionizing radiation.

4. Processing of products ionizing radiation shall be performed in the corresponding hygienic and technology conditions for achievement of the following purposes: prevention, reducings, quantitative destruction of the microorganisms causing spoil of products, prolongation of expiration date of products, control of the period of maturing.

5. The foodstuff which is subject to radiation shall be useful and contain in the corresponding sanitary condition. These products, as well as the corresponding packaging shall be compatible to processing by radiation.

6. Foodstuff can be processed by the ionizing radiation only if there is need connected with food hygiene, this processing is necessary from the technology point of view, and also for advantage of the consumer.

7. Processing by ionizing radiation cannot be used as replacement of hygienic measures or health, or good practice on production.

8. Requirements of these Regulations extend to activities for processing by ionizing radiation of the foodstuff and ingredients included in the lists approved by the Government.

9. Provisions of these Regulations are obligatory for execution by all operators of the sources of ionizing radiation used for these purposes irrespective of form of their property and departmental subordination.

10. In sense of these Regulations the used terms have the following values:

producer - the physical person or legal entity responsible for production, packaging and labeling of foodstuff before it gets on the market under own name, independently whether such transactions were executed by this person independently or the third parties from his name;

delivery to the market - action for delivery for the first time, for a fee or free of charge, products for its distribution and/or use in the market;

object for processing by ionizing radiation - the building which includes the radiation source, the equipment, set of works designed and laboratories authorized in accordance with the established procedure for the purpose of processing of foodstuff ionizing radiation;

processing of product ionizing radiation is the permitted radiation of product sufficient dose, according to requirements of the standards approved as national in the territory of the Republic of Moldova and the operating technologies.

11. Provisions of these Regulations are not applied for:
