1. Approve enclosed:

1) criteria for evaluation of risk degree in the sphere of private entrepreneurship in the field of protection of the rights of the child according to appendix 1 to this joint order;

2) form of checking leaf in the sphere of private entrepreneurship in the field of protection of the rights of the child according to appendix 2 to this joint order.

2. Declare invalid the joint order of the Minister of Education and Science of the Republic of Kazakhstan of March 1, 2010 No. 91, of the Minister of Economy and Budget Planning of the Republic of Kazakhstan of March 11, 2010 No. 129 "About approval of criteria for evaluation of risk degree and forms of checking sheets on checks in the field of protection of the rights and protection of interests of orphan children and children without parental support" (it is registered No. 12, is published 2010 in the Register of state registration of regulatory legal acts for No. 6140, in the Collection of acts of the central executive and other central state bodies of the Republic of Kazakhstan).

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this joint order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan;

3) publication of this joint order on official Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan.

4. To impose control of execution of this joint order on the vice-Minister of Education and Science of the Republic of Kazakhstan Sarybekov M. N.

5. Conducting planned inspections concerning small business entities within three years from the date of state registration is not allowed (except the created legal entities according to the procedure of reorganization and legal successors of the reorganized legal entities).

6. This joint order becomes effective after ten calendar days from the date of its first official publication, except for Item 5, which becomes effective since January 1, 2013.

Criteria for evaluation of risk degree in the sphere of private entrepreneurship in the field of protection of the rights of the child

1. Criteria for evaluation of risk degree in the sphere of private entrepreneurship in the field of protection of the rights of the child (further - Criteria) are developed for measure definition of risks for the purpose of reference of subjects of control to risk degrees.

2. In these Criteria the following concepts are used:

1) risk - probability of damnification as a result of activities of the checked subject of life or to health of the person, the environment, legitimate interests of physical persons and legal entities, valuable interests of the state taking into account severity of its consequences;

2) subjects of control - the physical persons and legal entities who are subjects of private entrepreneurship, performing activities for protection of the rights of the child.

3. Reference of subjects of control on risk groups is performed by initial and subsequent distribution according to appendix to these Criteria.

Initially all subjects of control treat average risk degree.

4. Subsequent distribution of subjects of control to risk groups is performed depending on the gained points.

Following the results of check subjects of control are distributed on risk degrees as follows, gathered:

1) from 10 to 19 points inclusive belong to insignificant risk degree;

2) from 20 to 40 points inclusive - to average risk degree;

3) from 41 points and above - to high risk.

5. In case of identification on unscheduled inspections of violations in the organizations depending on the amount of the gained points this organization is transferred to high or average risk degree.

6. On each organization observation case in which are filed the act of purpose of check, the checking sheet, necessary data on the main indicators of activities is processed.
