About approval of the Procedure for creation and giving of requests for public information which manager is the National commission on securities and the stock market

According to Item 13 of article 8 of the Law of Ukraine "About state regulation of the security market in Ukraine", for the purpose of ensuring fulfillment of requirements of the Law of Ukraine "About access to public information" the National commission on securities and the stock market RESHILA:

1. Approve the Procedure for creation and giving of requests for public information which manager is the National commission on securities and the stock market which is applied.

2. Approve the Size of actual expenses on copying or seal of documents which are provided on requests for information which manager is the National commission on securities and the stock market which is applied.

3. Determine person who will organize in accordance with the established procedure access to public information in central office of the National commission on securities and the stock market (further - NKTsBFR) which manager it is, the chief of staff.

4. To provide to management of information technologies, external and internal communications (A. Zaik):

functioning of Single base of requests for information of NKTsBFR;

support in urgent condition of the Section of the NKTsBFR official website "Access to public information" according to the Law of Ukraine "About access to public information".

5. To provide to structural divisions of central office:

timely processing, accounting and provision in certain terms of the reliable, exact and complete information concerning requests for public information which arrive from physical persons and legal entities, associations of citizens without the status of the legal entity;

preparation and provision to management of information technologies, external and internal communications (A. Zaik) of the corresponding materials for placement on the NKTsBFR official website and their updating, promulgation and control of relevance of information posted on the NKTsBFR official website according to article 15 of the Law of Ukraine "About access to public information".

6. Confer the personal responsibility for accomplishment of the Law of Ukraine "About access to public information", the Presidential decree of Ukraine of May 5, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information", this decision, and also for reliability and timely provision of information for official promulgation on requests for public information for heads of structural divisions.

7. To legal department (Martynenko I. I.) provide submission of this decision on state registration in the Ministry of Justice of Ukraine.

8. (Yu. Zhuly) to provide to department of external and internal communications of management of information technologies, external and internal communications publication of this decision according to the legislation.

9. This decision becomes effective from the date of its official publication.

10. I reserve control over the implementation of this decision.

Procedure for creation and giving of requests for public information which manager is the National commission on securities and the stock market of Ukraine

I. Creation and giving of requests for public information

1. This Procedure governs the relations connected with creation and giving of requests for public information which manager is the National commission on securities and the stock market (further - NKTsBFR), according to the Law of Ukraine "About access to public information" and does not extend to the relations in the sphere of addresses of citizens which are regulated by the Law of Ukraine "About addresses of citizens".

2. In this Procedure terms are used in the value given in the Law of Ukraine "About access to public information".

3. The request for information is sent by the physical, legal entity, associations of citizens without the status of the legal entity in NKTsBFR in oral, written or other form (by mail, by fax, phone, e-mail) at the choice of zaprashivatel.

4. For submission of the written request the zaprashivatel can use form (appendix 1) which is posted on the NKTsBFR website in the Section "Access to Public Information": www.nssmc.gov.ua.

5. In case when on reasonable excuses (disability, physical disabilities and so forth) person cannot send the written request, it is drawn up by employees of general department of NKTsBFR with indication of in request of the surname, name, middle name, contact telephone number and provide the copy of request to person who gave it.
