About approval of Rules of calculation of the amount of insurance indemnity in case of damnification to health of the victim

1. Approve the enclosed Rules of calculation of the amount of insurance indemnity in case of damnification to health of the victim.

2. This resolution becomes effective since January 1, 2013.

Rules of calculation of the amount of insurance indemnity in case of damnification to health of the victim

1. These rules determine procedure of payments of the amount of insurance indemnity (insurance payment) in case of damnification to health of the victim and establish standard rates for determination of the amount of insurance indemnity (insurance payment) in case of damnification to health of the victim, and also for determination of compensation amount on account of the indemnification caused to health of the victim proceeding from nature and damage rate of health, according to appendix (further - standard rates).

2. The amount of insurance indemnity (insurance payment) in case of damnification to health of the victim under the agreement of obligatory civil liability insurance of carrier for damnification of life, to health, property of passengers or under the agreement of obligatory civil liability insurance of the owner of dangerous object for damnification as a result of accident on dangerous object, and also the amount of insurance payment regarding compensation of necessary expenses on recovery of health of the victim for the agreement of obligatory civil liability insurance of owners of vehicles (further - agreements) are calculated the insurer by multiplication of the insurance sum specified on risk of damnification to health of the victim one victim in accordance with the legislation of the Russian Federation by the standard rates expressed as a percentage.

3. If the injuries of health of different nature and localization received by the victim are provided by several Items of appendix to these rules, the size of insurance indemnity is determined by summing of standard rates and multiplication of the received amount by the insurance sum specified on risk of the civil responsibility for damnification to health of the victim one victim in the agreement.

4. If owing to the harm done to health of the victim, medico-social examination establishes disability or category "handicapped child", to the victim payment of insurance indemnity in connection with disability is performed.

5. The amount of payment of insurance indemnity in connection with disability is determined depending on permanent disorder of functions of organism (restriction of activity and need of social protection) and group of disability according to the procedure, established by the legislation of the Russian Federation, and constitutes:

for the I group of disability - 100 percent of the insurance sum specified on risk of damnification to health of the victim in the agreement;

for the II group of disability - 70 percent of the insurance sum specified on risk of damnification to health of the victim in the agreement;

for III group of disability - 50 percent of the insurance sum specified on risk of damnification to health of the victim in the agreement;

for category "handicapped child" - 2 million rubles.

6. Payment of insurance indemnity in connection with disability is made by the insurer in case of establishment injured disability in the amount of difference between the amount of insurance indemnity in connection with disability taking into account the established group of disability and earlier effected payment of insurance indemnity depending on nature and damage rate of health of the victim.
