1. Approve the enclosed provisions:

Regulations on the medical and production state companies for performing labor therapy, training in new professions and employment at these companies of persons suffering from mental disturbances including disabled people

I. General provisions

1. The medical and production state company (structural division of the public and local government office giving mental health services) * for performing labor therapy, training in new professions and employment of persons suffering from mental disturbances including disabled people, is established in accordance with the legislation of the Russian Federation by body of health care of the subject of the Russian Federation or the ministry (department) having the organizations giving mental health services.

2. The main objectives of the company are labor therapy of persons suffering from mental disturbances; their labor training and retraining; the labor device of the specified persons (as workers and employees) who do not have employment opportunity on regular production on medical indications and other circumstances.

3. The company is legal entity, is on separate balance, has the settlement account in organization of bank, works at the principles of self-sufficiency. It can acquire on its own behalf the property and personal non-property rights, perform duties, to be claimant and the defendant in court, Arbitration Court, reference tribunal. The charter of the company affirms in accordance with the established procedure.

Relations of the company with the organization giving mental health services are determined by cooperation agreement. Are provided in the agreement obligation of the company for providing with work persons suffering from mental disturbances, the amount of assignments from profit to the specified organizations, participation of these organizations in medical attendance working and other conditions which the parties will count essential to the relations.

The company does not answer for obligations the organization giving mental health services, and organization - according to obligations of the company.

4. The company carries out the work with the purpose of expansion of opportunities for employment and labor employment of persons with mental disturbances on different specialties based on wide range of activities by production, performance of works and rendering the services satisfying public requirements and, including, for profit earning.

5. The property of the company is formed at the expense of property of the state transferred to the economic jurisdiction of the company, budgetary appropriations, the gained income, other legal sources. The company when implementing production economic activity will approve the main directions and forms of the work with management of the organization giving mental health services.

6. The states of administrative personnel of the company are established by management of the company according to recommendations of the Ministry of Health and the Medical Industry of the Russian Federation.

7. The medical personnel serving the company are included into staff of the organization giving mental health services.

II. Production economic activity

8. The company in coordination with management of the organization giving mental health services plans the activities and determines the prospects of the development proceeding from tasks of social and labor rehabilitation of persons suffering from mental disturbances. At the same time are considered as demand for the made products (works, services), and need of ensuring the production and social development, and also increase in personal incomes of the working persons.

9. The basis of the plan is constituted by the contracts signed with consumers (buyers) of products (works, services) including with state bodies and suppliers of material resources. The assortment and types of products are determined taking into account structure working at the company, conditions of their health, the experience, skills and other indicators considering specifics of the workers performing labor functions.

10. The company sells the products (works, services) at the prices and rates established independently or on contractual basis through wholesale and retail trade, other intermediary organizations, and also by participation in fairs, auctions and other similar actions.

11. The profit of the company is used mainly on improvement of working conditions and life of the working persons, their additional food including for working (for health reasons) at home, acquisition of the medical equipment and medicines.
