Regulations on procedure for rendering to citizens of assistance in employment in other area

I. General provisions

1.1. Regulations on procedure for rendering to citizens of assistance in employment in other area * (1) developed according to Item 2 of Article 12, Item 1 of article 28 of the Law of the Russian Federation "About employment of the population in the Russian Federation" in edition of April 20, 1996 N36-FZ (The Russian Federation Code, 1996, N 17, the Art. 1915), Item 13 of the Regulations on the State fund of employment of the population of the Russian Federation approved by the resolution of the Supreme Council of the Russian Federation of June 8, 1993 N5132-1 (Sheets of the Congress of People's Deputies of the Russian Federation and the Supreme Council of the Russian Federation, 1993, N 25, the Art. 911), the order of the Government of the Russian Federation of May 25, 1994 N533 "About Privileges for the Citizens Moving for Work to the Rural Zone" (The Russian Federation Code, 1994, N 6, the Art. 607).

1.2. The provision determines operating procedure of territorial authorities of Ministry of Labor of Russia concerning employment of the population * (2) by rendering to citizens assistance in employment and cost recovery in connection with voluntary moving to other area according to the offer of bodies for questions of employment (paragraph 5 of item 1 of Art. 28 of the Law of the Russian Federation "About employment of the population in the Russian Federation").

II. Work on rendering to citizens assistance in employment in other area

2.1. Bodies for questions of employment render services in assistance in employment in other area to the citizens addressing for the purpose of search of suitable work.

2.2. For the purpose of rendering assistance to citizens in employment in other area bodies for questions of employment carry out work on forming of databank of vacancies and free workplaces * (3), using:

data of the all-Russian bank of vacancies;

the information provided by the organizations located in other regions and addressing for assistance in personnel recruitment;

information on vacancies obtained by bodies for questions of employment from federal executive bodies, other organizations;

data of the non-state organizations rendering services in assistance to citizens in employment;

the data obtained from mass media.

2.3. For the purpose of acquaintance of citizens with information on employment opportunity in other area, bodies for questions of employment will organize open entry to information materials in which data are provided about:

availability of vacancies and free workplaces in the organizations located in other area;

nature, the mode, working conditions and qualification requirements, about the privileges provided to employees of these organizations;

possibilities of providing citizens with housing on place of employment in other area, about addresses and phones of the organizations for hiring of housing, other organizations which can render assistance on the matter.

2.4. After acquaintance with information materials the citizens including recognized as the unemployed have opportunity to resolve employment issues with voluntary moving to other area with assistance of bodies for questions of employment or independently, by the direct address to employers.

2.5. Bodies for questions of employment find out possibility of the direction of citizens for replacement of vacancies in these organizations according to the qualification requirements imposed by employers and professional training of the citizen, and also carry out coordination with the organization of question of employment of the specific candidate.

The Direction form (the appendix N1 to this Provision) is issued to citizens to whom vacancy is picked up.

2.6. Employment in other area in the direction of bodies for questions of employment in case of lack of suitable work on the residence can be offered to the citizens recognized in accordance with the established procedure as the unemployed.

2.6.1. Employment on the terms of the employment contract (contract) signed for certain term - for the period of accomplishment of certain work (temporary, seasonal or works as shift method).

2.6.2. Employment on the terms of the employment contract (contract) signed sine die at the initiative of the worker:

a) in the absence of offers of suitable work after the end of the initial period of unemployment;

b) within implementation of the federal target program of assistance of employment of the population of the Russian Federation, regional programs of employment, and also in connection with closing of the city-forming organizations after the end of the initial period of unemployment.

2.6.3. The direction of the jobless citizen for employment in other area is performed, as a rule, after obtaining from the employer of confirmation of possibility of acceptance and employment of the citizen (challenge or the invitation, etc.), including possibilities of provision of living space and possibility of the solution of question of payment of the state fee for registration at the new place of residence (the place of stay).

2.6.4. The jobless citizens who are especially needing social protection and experiencing difficulties in job search have the privilege for job placement to other area (item 2 of Art. 5 of the Law of the Russian Federation "About employment of the population in the Russian Federation").
