According to the Federal Law "About the Prevention of Distribution in the Russian Federation the Disease Caused by Human Immunodeficiency Virus (HIV — Infections)" (The Russian Federation Code, 1995, N 14, the Art. 1212) the Government of the Russian Federation decides:

Approve the enclosed Rules of performing obligatory medical examination on detection of human immunodeficiency virus (HIV infection).

Rules of performing obligatory medical examination on detection of human immunodeficiency virus (HIV infection)

1. These rules establish single procedure for obligatory medical examination of citizens of the Russian Federation, foreign citizens and stateless persons for the purpose of the prevention of distribution in the Russian Federation of the disease caused by human immunodeficiency virus (HIV infection).

2. Are subject to obligatory medical examination on detection of HIV infection:

blood donors, plasmas of blood, sperm and other biological liquids, fabrics and bodies - in case of each capture of donor material;

workers of separate professions, productions, the companies, organizations and organizations which list affirms the Government of the Russian Federation, - when carrying out obligatory preliminary in case of revenues to work and periodic medical examinations.

3. Person undergoing obligatory medical examination has the right to presence at the same time of the legal representative. Registration of representation is made according to the procedure, established by the civil legislation of the Russian Federation.

4. Obligatory medical examination on detection of HIV infection is carried out in medical institutions of the state and municipal health care systems having the license for carrying out such surveys.

5. The medical institutions which are carrying out obligatory medical examination on detection of HIV infection ensure safety of such survey both for osvidetelstvuyemy, and for person who is carrying out survey according to the established standard rates and standards.

6. The main method of obligatory medical examination is the blood serum research on availability of antibodies to human immunodeficiency virus. For these purposes only diagnostic medicines allowed in accordance with the established procedure for use in the territory of the Russian Federation are used.

7. The blood serum research on availability of antibodies to human immunodeficiency virus is carried out in 2 steps:

at the first stage the total range of antibodies against anti-genes of human immunodeficiency virus by means of the solid-phase immunofermental analysis comes to light;

at the second stage the immune bloting for the purpose of determination of antibodies to certain squirrels of human immunodeficiency virus is carried out.

In case of receipt of positive result at the first investigation phase on availability of antibodies to human immunodeficiency virus in serum of blood of osvidetelstvuyemy person carrying out immune bloting is obligatory.

8. The technique and technology of performing obligatory medical examination on detection of human immunodeficiency virus are determined by the Ministry of Health of the Russian Federation.

9. Obligatory medical examination on detection of HIV infection shall be carried out with initial and subsequent consulting concerning prevention of this disease.

10. Issue of the official document about availability or about absence of HIV infection at osvidetelstvuyemy person is performed only by organizations of the state or municipal health care system.

11. Person which underwent obligatory medical examination on detection of HIV infection is notified by the employee of the organization which was carrying out medical examination, on its results according to the procedure, established by the Ministry of Health of the Russian Federation.

12. Person which underwent obligatory medical examination has the right to repeated medical examination in the same organization, and also in other organization of the state or municipal health care system at the choice irrespective of the term which passed from the moment of the previous survey.

13. Obligatory medical examination on detection of HIV infection is carried out free of charge.

14. Health workers and other persons to whom in connection with accomplishment of service or professional duties data on results of performing medical examination on detection of HIV infection became known shall keep these data in secret.

15. For disclosure of the data which are medical secret, persons to whom these data became known in connection with accomplishment of the service or professional duties by them bear responsibility in accordance with the legislation of the Russian Federation.

16. Persons at whom HIV infection is revealed or which refused obligatory medical examination cannot be blood donors, plasmas of blood, sperm, other biological liquids, fabrics and bodies.

17. In case of detection of HIV infection at workers of separate professions, productions, the companies, organizations and the organizations which list affirms the Government of the Russian Federation these workers are subject in accordance with the legislation of the Russian Federation to transfer to other work excluding HIV infection distribution terms.

18. In case of refusal of passing of obligatory medical examination on detection of HIV infection without valid excuse the worker is subject to disciplinary responsibility in accordance with the established procedure.
