About approval of standards of the state services of the Ministry of Transport and Communications of the Republic of Kazakhstan and local executive bodies in the sphere of highways and modification and amendments in the orders of the Government of the Republic of Kazakhstan of September 5, 1998 No. 845 "About enhancement of legal support of road economy" and of July 20, 2010 No. 745 "About approval of the register of the state services rendered to physical persons and legal entities"

According to Article 34 of the Budget code of the Republic of Kazakhstan of December 4, 2008 and article 9-1 of the Law of the Republic of Kazakhstan of November 27, 2000 "About ministerial procedures" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) standard of the state service "Issue of Permission to Placement of Outdoor (Visual) Advertising in Strip of Withdrawal of Highways Public of the International and Republican Value";

2) standard of the state service "Issue of Permission to Placement of Outdoor (Visual) Advertising in Strip of Withdrawal of Highways Public of Regional and District Value, and also in Settlements";

3) standard of the state service "Issue of Permission to Crossings of Highways of the International and Republican Value by Channels, Communication Lines and Electricity Transmissions, Oil Pipelines, Gas Pipelines, Water Supply Systems and Railroads and Other Engineering Networks and Communications";

4) the subitem 4) of Item 1 is excluded according to the Order of the Government of the Republic of Kazakhstan of 10.06.2013 No. 591

5) the subitem 5) of Item 1 is excluded according to the Order of the Government of the Republic of Kazakhstan of 10.06.2013 No. 591

6) the subitem 6) of Item 1 is excluded according to the Order of the Government of the Republic of Kazakhstan of 10.06.2013 No. 591

7) standard of the state service "Issue of Permission to the Device of Congresses from Highways of the International and Republican Value and Platforms for Loading and Unloading of Freights";

8) the subitem 8) of Item 1 is excluded according to the Order of the Government of the Republic of Kazakhstan of 10.06.2013 No. 591

2. Bring the following changes and amendments in some decisions of the Government of the Republic of Kazakhstan:

1) in the order of the Government of the Republic of Kazakhstan of September 5, 1998 No. 845 "About enhancement of legal support of road economy" (SAPP of the Republic of Kazakhstan, 1998, No. 31, the Art. 269):

in the Instructions for use highways in the territory of the Republic of Kazakhstan approved by the specified resolution:

state Item 12-1 in the following edition:

"12-1. Road authorities no later than seven working days make coordination (perform issue of specifications and passports).

Divisions of road traffic police make coordination no later than seven working days.";

add with Items 23-1, 23-2, 23-3, and 23-4 of the following content:

"23-1. For receipt of coordination of road authorities on the device, reconstruction, repair and liquidation of railway crossings and deepening of beds of the rivers and water currents is higher or below bridges for meliorative and other purposes at distance of less 2,5 of km on highways of the international and republican value users of highways submit the following documents:

1) the written application in any form;

2) title (name) of the highway, address and types of works;

3) working project.

23-2. For receipt of coordination of road authorities on the device, reconstruction and repair of the locks, dikes and other meliorative and hydraulic engineering constructions combined with roads of the international and republican value or the roads located above on area bias users of highways submit the following documents:

1) the written application in any form;

2) title (name) of the highway, address and types of works;

3) the working project with distance of the hydraulic engineering construction from highways.

23-3. For receipt of coordination of road authorities on the device of congresses from highways of the international and republican value and platforms for loading and unloading of freights users of highways submit the following documents:

1) the written application in any form;

2) title (name) of the highway, address and types of works;

3) working project;

4) the scheme of adjunction, crossing to highways of the international and republican value with indication of the name of the highway and the address (km + m);

5) the scheme of arrangement of signs and barriers of production sites of works on adjunction and crossing to highways of the international and republican value.

23-4. For receipt of coordination of road authorities on rise and lowering of railway tracks or stacking of additional way when crossing with highways of the international and republican value users of highways submit the following documents:

1) the written application in any form;

2) title (name) of the highway, address and types of works;

3) working project;

4) the scheme of rise and lowering of railway tracks or stacking of additional way when crossing with highways of the international and republican value with indication of the name of the highway and the address;

5) the scheme of arrangement of signs and barriers of production sites of works of rise and lowering of railway tracks or stacking of additional way when crossing with highways of the international and republican value.";

in Rules of placement of outdoor (visual) advertizing in strip of withdrawal of the highways public approved by the specified resolution:

state Item 3 in the following edition:

"3. Sites of lands the strips of withdrawal of highways public which are not used by road authorities or the concessionary can be provided in temporary short-term land use under the agreement to physical persons and legal entities for placement of outdoor (visual) advertizing on condition of non-admission of decrease in transportnoekspluatatsionny qualities of the road, observance of safety requirements of movement of vehicles and environmental protection:

1) in strip of withdrawal of highways public of the international and republican value - authorized state body on highways;

2) in strip of withdrawal of highways public of regional or district value - local executive body of area or area.";

state Item 5 in the following edition:

"5. For receipt of permission to placement of objects of outdoor (visual) advertizing in strip of withdrawal of highways public owners of objects give to road authorities or local executive bodies under which authority highways public, statements for registration of placement of object, with indication of the location, the details are. The sketch of object with color scheme and the sizes is put to the statement.

Road authorities or local executive bodies determine the location of objects according to the statement (or recommend other place), and also check compliance of the sizes and decorating of objects of outdoor (vizulny) advertizing to requirements of the legislation of the Republic of Kazakhstan.";

state Item 7 in the following edition:

"7. The passport is issued by road body for highways public of republican value or local executive body for highways public of regional or district value and approved with divisions of road traffic police within five working days.

The passport is issued for no more, than for one year, and prolonged according to the written address of the owner of object of outdoor (visual) advertizing.

The passport is subject to renewal, in case of change of the sizes of the established objects.

The passport is terminated in case of detection of discrepancy of the actual sizes of object to the sizes brought in the passport.";

to state part one of Item 15 in the following edition:

"15. Unauthorized placement of objects of outdoor (visual) advertizing without the corresponding execution of documentation and its coordination in road authorities or local executive bodies, divisions of road traffic police is forbidden.";

2) ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 18.09.2013 No. 983

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Standard of the state service
"Issue of permission to placement of outdoor (visual) advertizing in strip of withdrawal of highways public of the international and republican value"

1. General provisions

1. The standard of the state service "Issue of Permission to Placement of Outdoor (Visual) Advertising in Strip of Withdrawal of Highways Public of the International and Republican Value" is developed by the Ministry of Transport and Communications of the Republic of Kazakhstan.

The state service "Issue of Permission to Placement of Outdoor (Visual) Advertising in Branch Strip Highways Public of the International and Republican Value" (further - the state service) appears regional departments of Committee of highways of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - territorial authority) to the addresses specified in appendix 1 to this standard and also through the Republican state company "Service Center of the Population" of Committee on control of automation of the state services and coordination of activities of service centers of the population of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - TsON) on alternative basis to the addresses specified on the www.con.gov.kz Internet resource through the web portal of "the electronic government": www.e.gov.kz or the E-litsenzirovaniye web portal of www.elicense.kz (further - the portal) to physical persons and legal entities (further - uslugopoluchatel).

2. Procedure for rendering the state service

2. Terms of rendering the state service:

in case of the appeal to territorial authority:

1) from the moment of filing of application - within five working days the passport or written motivated refusal are issued to uslugopoluchatel;

2) the most allowed time of expectation in queue in case of delivery of the statement specified in Item 7 of this standard, no more than 20 minutes;

3) the most allowed time of expectation in queue in case of receipt of the passport - no more than 20 minutes;

in case of the address:

1) in district department of TsON:

issue of the passport is performed within five working days (2 days of delivery of documents in TsON are not included into territorial authority and 2 days of the performed documents of rendering the state service in time);

2) in regional department of TsON:

issue of the passport is performed within five working days (day of reception of an application and documents does not enter rendering the state service in time);

3) the most allowed time of expectation in queue in case of delivery of the necessary documents specified in Item 7 of this standard, no more than 20 minutes;

4) the most allowed time of expectation in queue in case of receipt of the passport - no more than 20 minutes;

through the portal the service is rendered within five working days.

3. Form of the rendered state service: partially automated.

4. The rendered state service are result issue of the passport of placement of outdoor (visual) advertizing in strip of withdrawal of highways public of the international and republican value (further - the passport) or the motivated answer about refusal in provision of the state service in electronic form, certified by the digital signature (further - the EDS) of the official of territorial authority.

In case of the appeal to territorial authority behind receipt of the passport on paper, the passport is drawn up in electronic form, unpacked, certified by seal of territorial authority and the signature of his head.

5. The state service is rendered free of charge.

6. The state service is provided:

1) in case of the appeal to territorial authority:

daily Monday through Friday inclusive, except for days off and holidays, according to the established working schedule of territorial authority with lunch break;

acceptance is performed in turn, without making an appointment and the accelerated servicing;

information on procedure for rendering the state service is had on Internet resource of the Ministry of Transport and Communications of the Republic of Kazakhstan: www.mtc.gov.kz (in the subsection "State Services" of the Section "Committee of Highways") and at the stands located in premises of territorial authority on the place, most visible to uslugopoluchatel;

2) in case of the appeal to TsON:

daily Monday through Saturday inclusive, except for days off and holidays, according to the established working schedule TsON from 9:00 to 20:00 o'clock without interruption for lunch;

acceptance is performed according to the procedure of "electronic" queue, without making an appointment and the accelerated servicing;

information on procedure for rendering the state service is had on the TsON Internet resource: www.con.gov.kz and at the stands located in premises of TsON;

3) on the portal - round the clock;

information on procedure for rendering the state service is provided by means of the appeal to single contact center of "the electronic government" of 1414.

7. For receipt of the state service the following documents are submitted:

in case of the appeal to territorial authorities or TsON:

the documents submitted by uslugopoluchatel:

1) the statement in the form established in appendix 2 to this standard;

2) the copy of the sketch of object with color scheme and the sizes or its original (when giving in TsON - it is scanned and attached by the employee of TsON to electronic request);

3) the identity document of the authorized representative, and the document certifying powers on representation - in case of the address of the representative of uslugopoluchatel;

the documents received from the corresponding state information systems:

1) the data of documents proving the identity and certifying powers on representation (in case of notarially attested);

in case of documents acceptance the employee of territorial authority or TsON verifies authenticity of originals with copies or the reproduced electronic copies of documents then returns originals to uslugopoluchatel;

in case of delivery of the documents specified in this Item of this standard for receipt of the state service in territorial authority or TsON the receipt on acceptance of the relevant documents is issued to uslugopoluchatel with indication of:

1) numbers and dates of acceptance of request;

2) type of required state service;

3) quantities and names of the enclosed documents;

4) date (time) and place of issue of documents;

5) surnames, name, middle name of the official of territorial authority or the employee of TsON which adopted the statement on document creation;

in case of the address through the portal:

1) request in electronic form, the uslugopoluchatel certified by the digital signature;

2) the sketch of object with color scheme and the sizes attached to electronic request in the form of the electronic copy of the document;

in case of the address through the portal to uslugopoluchatel the notification report on acceptance of request for provision of the state service with indication of date and time of obtaining by uslugopoluchatel of result of the state service goes to "private office".

8. The basis for refusal in provision of the state service are:

1) discrepancy of the documents specified in Item 7 of this standard, to the requirements established by normative and technical documents in the field of highways;

2) the bases, the stipulated in Article 40 Laws of the Republic of Kazakhstan of January 11, 2007 "About informatization".

In case of representation by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 7 these standards, the employee of TsON refuses reception of an application.

3. Procedure for appeal

9. For explanation of procedure for appeal of actions (failure to act) of the official of territorial authority or the employee of TsON and rendering assistance in preparation of the claim the uslugopoluchatel contacts management of territorial authority or TsON the address and phones specified in appendix 1 to this standard and on Internet resource: www.con.gov.kz.

Information on procedure for appeal can be obtained by phone directory service of single contact center of "the electronic government" of 1414.

10. In case of disagreement with result of the rendered state service, the claim is submitted addressed to the chairman of Committee of highways of the Ministry of Transport and Communications of the Republic of Kazakhstan (further - Committee) to the address: 010000, city of Astana, Prospekt Kabangbai of the batyr, 32/1, reception phone: 8(7172) 24-33-83.

The working schedule constitutes five-day business week from 9:00 to 18:30, except for of days off and holidays, with lunch break from 13:00 till 14:30.

11. In case of incorrect servicing:

the employee of TsON, the claim is submitted addressed to the head of TsON to the addresses and phones specified on the www.con.gov.kz Internet resource or to the address: 010000, city of Astana, Prospekt Respubliki, house No. 43 "A", phone: 8 (7172) 94-99-95;

the employee of territorial authority, the claim is submitted addressed to the head of territorial authority to the addresses and phones specified in appendix 1 to this standard or to the address: 010000, city of Astana, Prospekt Kabangbai of the batyr 32/1, building "Transport Tower".

12. In case of disagreement with results of the rendered state service, the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation.

13. Claims are submitted in any type on paper by mail.

14. The coupon in which are specified number, date, surname of person which accepted the claim with indication of contact information, and also the term and the place of receipt of the answer, contact information of officials at which it is possible to learn about the course of consideration of the claim is issued to Uslugopoluchatel in confirmation about adoption of its claim by person who accepted the claim.

The claim is considered within five working days from the date of its registration.

15. The additional information about the state service can be obtained by phone directory service of single contact center of "the electronic government" of 1414.

4. Other requirements

16. Requirements taking into account features of rendering the state service electronically and through TsON are absent.
