About approval of Regulations of bill works of the Cabinet of Ministers of the Kyrgyz Republic

For the purpose of further enhancement of the organization and coordination of bill activities of the ministries, the state committee, administrative departments, and also decides improvement of quality of the developed drafts of the laws of the Cabinet of Ministers of the Kyrgyz Republic:

1. Approve Regulations of bill works of the Cabinet of Ministers of the Kyrgyz Republic (further - Regulations) according to appendix.

2. To the ministries, state committee, administrative departments:

- accept Regulations to management and strict execution;

- organize work in central offices and structural divisions on studying of provisions of Regulations.

3. Recognize invalid:

- The order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of August 4, 2008 No. 419 "About approval of Regulations of bill works of the Government of the Kyrgyz Republic" of August 14, 2009 No. 526.

Regulations of bill works of the Cabinet of Ministers of the Kyrgyz Republic

These Regulations of bill works of the Cabinet of Ministers of the Kyrgyz Republic (further - Regulations) determine procedure for the organization and implementation of bill work of the Government of the Kyrgyz Republic (further - the Cabinet of Ministers).

1. General provisions

1. The Cabinet of Ministers participates in bill activities by means of development and promotion in accordance with the established procedure of drafts of the laws.

The chairman of the Cabinet of Ministers exercises power to initiate legislation by means of introduction of bills for consideration of Jogorku Kenesh of the Kyrgyz Republic (further - Jogorku Kenesh) according to the plan of bill works of the Cabinet of Ministers of the Kyrgyz Republic (planned bills) or out of this plan (unplanned bills).

2. Bill activities of the Cabinet of Ministers are performed according to the Constitution of the Kyrgyz Republic, the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the laws of the Kyrgyz Republic "About Regulations of Jogorku Kenesh of the Kyrgyz Republic", "About regulatory legal acts of the Kyrgyz Republic", other regulatory legal acts of the Kyrgyz Republic and these Regulations.

3. The main directions of bill activities are:

1) for the Cabinet of Ministers:

- development by the ministries, the state committee, administrative departments and other state bodies (further - the ministries and departments) bills, their introduction in accordance with the established procedure for consideration of the Chairman of the Cabinet of Ministers. Drafts of the laws are introduced to Jogorku Kenesh by the Chairman of the Cabinet of Ministers;

- making the official conclusion on the drafts of the laws initiated by subjects of the legislative initiative, except for initiated by the President and the Chairman of the Cabinet of Ministers, according to the procedure, established by the constitutional Law "About the Cabinet of Ministers of the Kyrgyz Republic";

- ensuring permanent interaction with Jogorku Kenesh, participation in its work for the purpose of passing tracking, and also ensuring adoption of the bills introduced by the Chairman of the Cabinet of Ministers according to the procedure of the legislative initiative;

- control over the implementation of bill works within the international obligations of the Kyrgyz Republic;

2) for the permanent representative of the President and the Cabinet of Ministers in Jogorku Kenesh:

- ensuring representation of interests of the Cabinet of Ministers in Jogorku Kenesh under the bills introduced by the Chairman of the Cabinet of Ministers;

- coordination of activities of the ministries and departments, structural divisions of Presidential Administration concerning passing of legislative initiatives of the Chairman of the Cabinet of Ministers in Jogorku Kenesh;

- coordination of activities of the ministries and departments of planning of bill work and forming of the list of the urgent bills initiated by the Chairman of the Cabinet of Ministers for consideration by Jogorku Kenesh in extraordinary procedure;

- introduction of suggestions for improvement of bill activities of the Cabinet of Ministers;

- interaction with the Ministry of Justice of the Kyrgyz Republic concerning coordination of bill activities of the ministries and departments;

- ensuring permanent interaction of official representatives of the Cabinet of Ministers under the bill with Jogorku Kenesh, participation in its work for the purpose of tracking and monitoring of passing, and also implementation of ensuring adoption of the bills introduced by the Chairman of the Cabinet of Ministers according to the procedure of the legislative initiative;

3) for the Ministry of Justice of the Kyrgyz Republic (further - the Ministry of Justice):

- coordination of bill activities of the ministries and departments;

- forming of the Plan of bill works according to Item 9 of these Regulations, its introduction in accordance with the established procedure on approval in the Cabinet of Ministers, and also control of its execution;

- coordination of activities and work with the international organizations dealing with issues of bill work, and implementation joint with them and the interested state bodies of project development of the laws, conducting their complex examination and introduction in accordance with the established procedure in the Cabinet of Ministers;

- implementation of organizational and methodical and technical supply of activities of the Interdepartmental commission on implementation of international humanitarian law;

- carrying out inventory count of the legislation of the Kyrgyz Republic within activities of the Interdepartmental commission under the Ministry of Justice of the Kyrgyz Republic on inventory count of regulatory legal acts of the Kyrgyz Republic;

- improvement of quality of the bills drafted by the ministries and departments;

- generalization in the single bill of the amendments providing modification of editorial and technical nature (not raising industry questions) and entering of such bills into Presidential Administration no more than two times a year;

4) for the ministries and departments:

- planning and analysis of bill activities;

- entering of offers on inclusion of bills into the Plan of bill works of the Cabinet of Ministers for the corresponding year;

- development of bills;

- participation in preparation of the bills drafted by state bodies and local government bodies;
