About technical regulation and standardization

This Law is directed to regulation of the relations arising in case of development, establishment and application of technical requirements to products, other objects of technical regulation and subjects of standardization, other related relations and also to determination of legal and organizational basis of technical regulation and standardization, single state policy in this area.
1. For the purposes of this Law the following main terms and their determinations are used:
1.1. state registration - activities for assignment of registration numbers to technical regulations of the Republic of Belarus, technical codes of common practice, state standards of the Republic of Belarus (further - state standard), to nation-wide qualifiers of the Republic of Belarus (further - the nation-wide qualifier), to specifications, except for the specifications which are not subject to state registration according to Item 5 of article 26 of this Law for the purpose of accounting and identification of these acts;
1.2. The state system of cataloguing of products - the state information system providing collection, processing, accumulating, storage, distribution and (or) provision of information obtained when cataloguing products;
1.3. state standard – the standard which is technical regulatory legal act and approved by the State committee on standardization;
1.4. the documents in the field of technical regulation and standardization which are not technical regulatory legal acts (further – documents in the field of technical regulation and standardization), – international standards, interstate and other regional standards, and also other documents in the sphere of technical regulation and standardization accepted by the international organizations or foreign states, cases which procedure and limits of application are set by this Law, legal acts of the President of the Republic of Belarus and (or) international treaties of the Republic of Belarus, except for the international legal acts constituting the right of the Eurasian Economic Union (further – the right of the Eurasian Economic Union);
1.5. cataloguing of products – activities for identification, separation and group for certain signs, coding and streamlining (the uniform description) of information on the product range and the technical requirements to it established by technical regulatory legal acts and documents in the field of technical regulation and the standardization, for the purpose of accounting of the nomenclature made in the Republic of Belarus and imported on its territory of products, providing the interested subjects of technical regulation and standardization with information on the nomenclature and properties of such products, her manufacturers of providing the prevention of the actions misleading consumers of products concerning its purpose, quality and safety, increase in product competitiveness, its technical compatibility and interchangeability, implementation of public procurements of goods and in other purposes established by acts of the legislation;
1.6. the interstate standard – the regional standard accepted by Interstate council on standardization, metrology and certification of the Commonwealth of Independent States;
1.7. International Organization for Standardization – the international organization performing activities for standardization, members (participants) of which can be national authorities on standardization of any state;
1.8. the international standard – the standard accepted by International Organization for Standardization;
1.9. National system of technical regulation and standardization of the Republic of Belarus – set of technical regulatory legal acts in the field of technical regulation and standardization, the information resources containing such acts, subjects of technical regulation and standardization, and also rules and procedures of functioning of system in general;
1.10. national institute on standardization – the state organization subordinated to the State committee on standardization to which functions of carrying out scientific research in the field of methodology of technical regulation and standardization, other functions in the field of technical regulation and standardization according to this Law and other acts of the legislation are assigned;
1.11. National fund of technical regulatory legal acts – the systematized fund of technical regulatory legal acts, international standards, interstate and other regional standards, information on them, and also other documents and information resources provided by acts of the legislation on papers and (or) in the form of computer databank with the help and search device on the basis of information technologies;
1.12. the nation-wide qualifier – the technical regulatory legal act developed in the course of standardization and containing the technical requirements, obligatory for observance, directed to distribution of technical and economic and social information according to its classification (classes, groups, types and other classification groups);
1.13. subjects of standardization – products, processes of development, designing, researches, productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization and utilization of products, performance of works, rendering services, management system (management), testing, research and measurement, sampling, terminology, symbolics, packaging, marking, labels and their drawing, competence of personnel of accomplishment of certain works, rendering certain services, competence of the legal entity of the Republic of Belarus or the foreign legal entity in performance of works on assessment of conformity to technical requirements, other objects concerning which perhaps establishment of technical requirements in the course of standardization is also necessary;
1.14. objects of technical regulation – products or products and the processes of development, designing, researches connected with technical requirements to products, productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization and utilization;
1.15. industry standardization organization – the state organization subordinated to republican state body, created (determined) by it in need of established procedure for carrying out scientific research in the field of technical regulation and standardization taking into account specifics of certain industry of economy or field of activity, implementation of other functions in the field of technical regulation and standardization according to this Law and other acts of the legislation;
1.16. the official publication – the printing or electronic edition with the text of technical regulatory legal act in the field of technical regulation and standardization and (or) the interstate standard and (or) information on such act and (or) the standard which is prepared, made, published and extends it (is provided) by the subjects of technical regulation and standardization specified in Items 3-8 of article 31 of this Law;
1.17. official distribution (provision) – sale or distribution (provision) of the official publication otherwise on paid or non-paid basis, and also distribution (provision) of the text of technical regulatory legal act in the field of technical regulation and standardization and (or) the interstate standard and (or) information on such act and (or) standard electronically on paid or non-paid basis, including as a part of bases and databanks, other information resources, including the information resources placed on the global computer Internet which is performed by the subjects of technical regulation and standardization specified in Items 3-8 of article 31 of this Law;
1.18. check of technical regulatory legal act in the field of technical regulation and standardization – activities for periodic assessment of scientific and technical level of the approved technical regulatory legal act in the field of technical regulation and standardization, to the analysis of its coordination with other acts of the legislation, international treaties of the Republic of Belarus, technical regulations of the Eurasian Economic Union, compatibility with international standards, interstate and other regional standards which is performed after enforcement of this act by the subject of technical regulation and standardization who approved such act and (or) organized its development and as a result of which the conclusion about preserving it in operation without review and change or about need of review, change or cancellation of such act is drawn;
1.19. products – the result of activities provided in material and material form and intended for further use in economic and other purposes;
1.20. work – activities which results have material expression and can be implemented for requirements satisfaction of legal entities of the Republic of Belarus, foreign or international legal entities (the organizations, not being legal entities) (further if other is not determined, – legal entities) or citizens of the Republic of Belarus, foreign citizens or stateless persons, including individual entrepreneurs (further if other is not determined, – physical persons);
1.21. regional standardization organization – the international organization performing activities for standardization, members (participants) of which can be national authorities on standardization of the states entering certain geographical or other region of the world or being according to international treaties in process of economic integration;
1.22. the regional standard – the standard accepted by regional standardization organization;
1.23. System of complex information support in the field of technical regulation and standardization – the organized set of the state information resources in the field of technical regulation and standardization and information technologies providing interaction of subjects of technical regulation and standardization in planning process of activities for technical regulation and standardization, developments, approvals, state registration, check, review, change, cancellation, application, official interpretation and official distribution (provision) of technical regulatory legal acts in the field of technical regulation and standardization, implementation of other activities in the field of technical regulation and standardization;
1.24. the standard – the document developed in the course of standardization on the basis of the consent of most of the interested subjects of technical regulation and standardization and containing technical requirements to subjects of standardization;
