RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About measures for implementation of the Law of the Republic of Belarus "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP"

According to part four of Article 7 and article 41 of the Law of the Republic of Belarus of May 26, 2012 No. 385-Z "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for reference of the lands which are in the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP to radiation dangerous and their exceptions of radiation dangerous lands it (is applied).

2. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. in Item 22, the paragraph the fifth Item 34 of Instructions for use wild animals in the scientific, educational and educational, and also recreational, esthetic and other purposes in process of implementation of cultural activities approved by the resolution of Council of Ministers of the Republic of Belarus of June 2, 2006 No. 700 (The national register of legal acts of the Republic of Belarus, 2006, No. 90, 5/22408; 2008, No. 108, 5/27579), words" (in evacuation area (alienation), zone of first-priority settling out, the subsequent settling out from which the population is settled out)" shall be replaced with words "(in evacuation area (alienation), zone of first-priority settling out, zone of the subsequent settling out from which the population is settled out and on which the check mode is set)";

2.2. Item 3 of the resolution of Council of Ministers of the Republic of Belarus of November 17, 2006 No. 1543 "About some questions of implementation of the Presidential decree of the Republic of Belarus of October 20, 2006 No. 622" (2006, 198, 5/24251) to state the national register of legal acts of the Republic of Belarus to No. in the following edition:

"3. To the property located in the territory which underwent to the radioactive pollution as a result of catastrophic crash on the Chernobyl NPP called in the paragraph the second subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of October 20, 2006 No. 622, concerning which revaluation is not made, the property which is in the territories of evacuation area (alienation), zone of first-priority settling out, zone of the subsequent settling out from which the population is settled out and on which the check mode is set determined according to article 6 of the Law of the Republic of Belarus of May 26, 2012 "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" belongs (The national register of legal acts of the Republic of Belarus, 2012, No. 63, 2/1937).";

2.3. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 24.06.2014 No. 614

2.4. Item 48 of Service regulations (servicing) of the meliorative systems and separately located hydraulic engineering constructions approved by the resolution of Council of Ministers of the Republic of Belarus of July 10, 2009 No. 920 "About some questions of operation (servicing) and conducting the state accounting of meliorative systems and separately located hydraulic engineering constructions" (National register of legal acts of the Republic of Belarus, 2009, No. 183, 5/30173), to state in the following edition:

"48. The relations arising when holding meliorative actions in the territories which underwent to radioactive pollution are regulated by the laws of the Republic of Belarus of July 23, 2008 "About land reclamation" (The national register of legal acts of the Republic of Belarus, 2008, No. 184, 2/1520) and of May 26, 2012 "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" (The national register of legal acts of the Republic of Belarus, 2012, No. 63, 2/1937), the legislation on radiation safety and these rules.";

2.5. in the State program on overcoming effects of catastrophic crash on the Chernobyl NPP for 2011-2015 and for the period till 2020, the Republic of Belarus approved by the resolution of Council of Ministers of December 31, 2010 No. 1922 (The national register of legal acts of the Republic of Belarus, 2011, No. 10, 5/33118; No. 50, 5/33698; No. 92, 5/34264):

2.5.1. in the passport of the State program:

shall be replaced with words the words "ensuring reliable functioning of republican system of radiation control" "coordination of work on ensuring control of radioactive pollution";

words of "exclusion zones and settling out" shall be replaced with words "evacuation areas (alienation), zones of first-priority settling out, zone of the subsequent settling out";

2.5.2. in Chapter 1:

in part two of the word "of November 12, 1991 " about legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP " (Vyarkho¸naga Savet's Vedamasts_ of Respubl_k_ Belarus, 1991, No. 35, the Art. 622), of November 23, 1993 " about sanitary and epidemic wellbeing of the population " (Vyarkho¸naga Savet's Vedamastsi of Respubliki Belarus, 1993, No. 36, the Art. 451)" shall be replaced with words "of May 26, 2012 "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP" (The national register of legal acts of the Republic of Belarus, 2012, No. 63, 2/1937), of January 7, 2012 "About sanitary and epidemiologic wellbeing of the population" (The national register of legal acts of the Republic of Belarus, 2012, No. 8, 2/1892)";

word part nine in paragraph five of "radiation control" shall be replaced with words "control of radioactive pollution";

2.5.3. in Chapter 2 part two:

the tenth to state the paragraph in the following edition:

"coordination of work on ensuring control of radioactive pollution;";

word in paragraph eleven of "exclusion zones and settling out" shall be replaced with words "evacuation areas (alienation), zones of first-priority settling out, zone of the subsequent settling out";

2.5.4. in Chapter 4:

in part one:

the fourth to state the paragraph in the following edition:

"ensuring carrying out radiation monitoring and control of radioactive pollution;";

word in paragraph five of "exclusion zones and settling out" shall be replaced with words "evacuation areas (alienation), zones of first-priority settling out, zone of the subsequent settling out";

third to exclude part;

the fourth - the sixty fourth to consider parts respectively parts of third-sixty third;

the tenth to state the paragraph to part eight in the following edition:
