We report that legal and economic basis of systems of standardization and certification is determined by the Decree of the Cabinet of Ministers of Ukraine "About standardization and certification" (further - the Decree).

Operation of the Decree extends to the companies, organizations and the organizations irrespective of the patterns of ownership and types of activity operating in the territory of Ukraine and also to citizens - subjects of business activity.

Besides, according to article 27 of the Decree, its action extends also to physical persons in case of import of vehicles, and also nodes, aggregates and parts by them to these means.

According to article 18 of the Decree compliance of products (goods) which are imported and implemented in the territory of Ukraine to the standards existing in Ukraine shall be confirmed by the certificate of conformity or the certificate on recognition of compliance granted or acknowledged central executive body concerning technical regulation or the certification body akcreditirovanny in accordance with the established procedure authorized on implementation of these activities in legislatively regulated sphere.

Customs authorities perform customs clearance of import goods based on the Unified register of products certified in Ukraine according to the procedure, established by the Cabinet of Ministers of Ukraine.

Procedure for customs clearance of goods which are imported on customs area of Ukraine and are subject to obligatory certification in Ukraine, No. 446 is approved by the resolution of the Cabinet of Ministers of Ukraine of 14.05.2008.

The goods which are subject to obligatory certification during movement through customs border of Ukraine are specified in appendix 7 to the resolution of the Cabinet of Ministers of Ukraine of 21.05.2012 No. 436.

So, in particular, the goods included in the List of products which are subject to obligatory certification in Ukraine, approved by the order of the State committee of Ukraine concerning technical regulation and consumer policy of 01.02.2005 No. 28 are subject to obligatory certification.

Cutleries which are classified in goods items 8211 and 9307 according to UKTVED are not included to the List of products which are subject to obligatory certification in Ukraine.

Thus, customs clearance of goods in free circulation which are imported on customs area of Ukraine and are classified in the goods items stated above according to UKTVED, it is performed without provision of the certificate to compliance or certificates on recognition of compliance.
