1. Approve enclosed:

criteria of reference of solid, liquid and gaseous waste to radioactive waste;

criteria of reference of radioactive waste to special radioactive waste and to the deleted radioactive waste;

criteria of classification of the deleted radioactive waste.

2. The criteria approved by this resolution are applied in case of:

implementation of activities in the field of use of atomic energy, including the activities connected with development, production, testing, operation and utilization of nuclear weapon and military nuclear power plants;

mitigations of consequences of radiation accidents;

rehabilitations of radiation contaminated territories including formed as a result of accomplishment of the state program of arms and the state defense order, use of nuclear charges in the peace purposes;

implementation of the types of activity which are not connected with use of atomic energy on production and conversion of mineral and organic raw materials with the increased content of natural radionuclides.

3. To federal executive bodies and State Atomic Energy Corporation "Rosatom" in 9-month time to bring the regulatory legal acts into accord with this resolution.

Criteria of reference of radioactive waste to special radioactive waste and to the deleted radioactive waste

1. The radioactive waste formed as a result of accomplishment of the state program of arms and the state defense order, use of nuclear charges in the peace purposes or owing to nuclear and (or) radiation accident on subject to use of atomic energy, the liquid radioactive waste placed in superficial reservoirs - storages of the radioactive waste with a total amount more than 25000 CBM put into operation before entry into force of the Federal Law "About the Treatment of Radioactive Waste and about Modification of Separate Legal Acts of the Russian Federation" and also the ground deposits of such reservoirs storages corresponding to the following criteria belongs to special radioactive waste:

a) calculated according to the federal regulations and rules, and also health regulations regulating the treatment of radioactive waste in the field of ensuring radiation safety collective effective dose of radiation for the entire period of potential danger of radioactive waste and risk of potential radiation connected with removal of radioactive waste exceed collective effective dose of radiation for the entire period of potential danger and risk of potential radiation connected with burial of radioactive waste in the place of their stay;

b) the expenses connected with removal of radioactive waste (including expenses on their extraction, conversion, conditioning, transportation to Item of burial and burial), calculated according to the technique of determination of structure of costs approved by State Atomic Energy Corporation "Rosatom" exceed the cumulative extent of possible harm to the environment in case of burial of such radioactive waste in the place of their stay calculated in accordance with the legislation of the Russian Federation about environmental protection and expenses on burial of such radioactive waste in the place of their stay (including expenses on transfer of Item of storage of radioactive waste in Item of burial of radioactive waste, its operation and closing, on safety during the entire period of potential danger of radioactive waste);

c) the Item of storage of radioactive waste and its sanitary protection zone are placed outside the boundaries of settlements, especially protected natural territories, coastal protective strips and the water protection zones of water objects, other conservation and protective zones established in accordance with the legislation of the Russian Federation.

2. The radioactive waste which is not carried to special radioactive waste according to Item 1 of this document belongs to the deleted radioactive waste.
