Approve the enclosed Rules of determination of the adjusting factor applied by non-state pension fund in case of adjustment of the size of funded pension and (or) the size of due retirement benefit.

Rules of determination of the adjusting factor applied by non-state pension fund in case of adjustment of the size of funded pension and (or) the size of due retirement benefit

1. These rules establish procedure for determination of the adjusting factor applied by non-state pension fund (further - fund) in case of adjustment of the sizes of funded pension and (or) the sizes of the due retirement benefit performed according to the procedure established to insured persons, provided by the Federal Law "About Procedure for Financing of Payments at the expense of Means of Pension Accruals" (further - adjusting factor).

2. The adjusting factor is determined by fund separately by results of investment of means of payable reserve (further - adjusting factor 1) and by results of investment of means of pension accruals of insured persons which establishes due retirement benefit (further - adjusting factor 2).

3. Adjusting factors are calculated to within the twelfth decimal sign by division:

money value of funds of payable reserve for money value of obligations assumed by fund concerning insured persons for payment to the funded pension established by it - for adjusting factor 1;

money value of means of pension accruals of insured persons which establishes due retirement benefit, on money value of obligations assumed by fund concerning these insured persons for implementation of the due retirement benefit established by it - for adjusting factor 2.

The money value of the appropriate means and obligations of fund specified in this Item is determined according to the procedure, established by orders of the Government of the Russian Federation of October 18, 2012 N 1061 and of October 18, 2012 N 1062.

4. The adjusting factor calculated according to the procedure of stipulated in Item 3 these rules, is subject to revision if the amount of the funds allocated by fund for adjustment of the size of funded pension and (or) the size of due retirement benefit determined with its accounting will exceed income amount (positive results) from investment of appropriate means of pension accruals.

At the same time review of adjusting factor is performed proceeding from money value of means of payable reserve or money value of means of pension accruals of insured persons which establishes due retirement benefit, reduced by difference between respectively an amount of means for adjustment of funded pension and income amount (positive results) from investment of means of payable reserve or between amount of means for adjustment of due retirement benefit and income amount (positive results) from investment of means of pension accruals of insured persons which establishes due retirement benefit.
