1. General provisions

1. These rules of compensation to the staff of special state bodies and members of their families of costs for journey on transport on the territories of the Republic of Kazakhstan and transportation of property (further - Rules) 77 and 78 Laws of the Republic of Kazakhstan of February 13, 2012 "About special state bodies of the Republic of Kazakhstan" are drafted according to Articles 73, (further - the Law) and determine procedure for compensation to the staff of special state bodies (further - employees) and to members of their families of costs for journey on transport on the territories of the Republic of Kazakhstan and transportation of property.

2. Procedure for compensation to the staff of special state bodies and members of their families of costs for driving on transport through the territory of the Republic of Kazakhstan

2. Cost recovery for driving on transport through the territory of the Republic of Kazakhstan is made to the following persons:

1) to employees (except cadets of special (military) educational institutions) in case of the next events:

following on hospitalization on medical indications and back;

following on physical examination (survey) and back based on the direction issued according to the procedure, established by the Government of the Republic of Kazakhstan;

movement on service;

dismissal from service, except the cases provided by subitems 4), 6), 7), 11), 12), 13) of Item 1 of article 49 of the Law;

2) to cadets of special (military) educational institutions in case of the next events:

following on hospitalization and back;

following in leave and back;

dismissal from service, except the cases provided by subitems 4), 6), 7), 11), 12), 13) of Item 1 of article 49 of the Law;

3) to members of families of employees (except cadets of special (military) educational institutions), constantly jointly living with them, in case of the next events:

movement of the employee on service;

dismissal of the employee from service, except the cases provided by subitems 4), 6), 7), 11), 12), 13) of Item 1 of article 49 of the Law.

Are understood as members of the family of employees: spouse (spouse); joint or one of spouses the minor children (adopted, who are in dependence or under guardianship); the children (adopted, who are in dependence or under guardianship) and children of the spouse (spouse), students in the organizations of education for full-time courses aged up to 23 years; the handicapped children (adopted, who are in dependence or under guardianship) and the handicapped children of the spouse (spouse) who became disabled people up to 18 years; the parents and parents of the spouse (spouse) who are dependent on the employee. Cost recovery to employees and members of their families is performed according to the regulations approved by the first heads of special state bodies upon the taken place event and made by that public institution of special state body (further - organization) where employees are on the staff (order), and in case of dismissal of the employee - territorial authority at the place of residence elected by him.

When moving the employee on service cost recovery is performed by organization to which the employee arrived for further service.

4. The way from the duty station or the employee's residence to the venue of event and back based on the shown travel documents is subject to payment.

5. In cases of untimely arrival or departure of transport, the employee shows the document testimonial of delay of transport which is issued by carrier at the request of the passenger.

6. In case of compensation to the employee, the cadet of special (military) educational institution of costs for journey in case of dismissal from service, the territorial authority at the place of residence chosen the called face requests from organization in the place of service of person the statement from the order on its dismissal from service.

7. For implementation of cost recovery for journey by the employee, cadet of special (military) educational institution within 10 working days after making of event the following documents are submitted:

1) the official report in form according to appendix 1 to these rules - for employees and cadets of special (military) educational institutions;

2) the statement in form according to appendix 2 to these rules - for the dismissed from service staff, cadets of special (military) educational institutions;
