3. This resolution becomes effective after ten calendar days after the first official publication.

Approved by the Order of the Government of the Republic of Kazakhstan of October 8, 2012, No. 1266
1. The state service appears divisions of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry of Internal Affairs) and the managements of migratory police of departments of internal affairs of the cities of Astana, Almaty and areas (further - UMP DVD) specified in appendix 1 to this standard.
2. Form of the rendered state service: not automated.
3. The state service is rendered on the basis:
1) article 40 of the Law of the Republic of Kazakhstan of January 15, 2013 "About Frontier of the Republic of Kazakhstan";
2) article 9 of the Law of the Republic of Kazakhstan of July 22, 2011 "About population shift";
3) article 24 of the Law of the Republic of Kazakhstan of June 19, 1995 "About legal status of foreigners".
4. The complete information about the state service and necessary documents, and also samples of forms of their filling are located on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan (www.mvd.kz in the Sections "About Activities of Law-enforcement Bodies") and departments of internal affairs of areas and the cities of Astana, Almaty (further - DVD), according to appendix 1 to this standard, and also in official sources of information and at the stands located in divisions of migratory police.
5. Issue of the omission on entrance to border area according to appendix 2 to this standard is result of the rendered state service. The omission is sealed also by the signature of the chief of division of migratory police of the Ministry of Internal Affairs or UMP DVD respectively.
6. The state service is rendered to physical persons and legal entities.
7. Terms of rendering the state service:
1) from the moment of delivery by the consumer of the necessary documents specified in Item 11 of this standard within 7 working days;
2) the most allowed time of expectation before receipt of the state service rendered on the place in day of the address of the consumer, no more than 15 minutes;
3) the most allowed time of consumer service in day of the address no more than 15 minutes.
8. The state service is rendered free of charge.
9. The state service is provided in the working days six days a week (Monday Friday from 9-00 till 18-00 o'clock, with lunch break from 13-00 to 14-30, on Saturday from 9-00 till 13-00 o'clock). Acceptance is performed in turn, without making an appointment and the accelerated servicing.
10. Premises of divisions of migratory police in which this state service is rendered are located on the first floor of the building, have entrance, separate of other divisions of law-enforcement bodies, with the ramps intended for access for physically disabled people, the waiting room, places for filling of documents are equipped with stands with the list of necessary documents and models of their filling.
11. For receipt of omissions on entrance to border area and stay in it physical persons and legal entities represent to law-enforcement bodies at the place of residence the following documents:
1) physical persons - written applications, according to appendix 3 to this standard, and the documents confirming the entrance purpose (the certificate of local executive body of accommodation of relatives, challenge for study);
2) legal entities - the petition on behalf of administration of the company or the organization according to appendix 4 to this standard.
If groups of citizens go for work in border area, lists are represented in triplicate. The first copy of the list is certified by the signature of the head of department (department) of migratory police or his deputy, sealed by visa, handed to the head of group; the second copy remains in law-enforcement body, the third copy goes for check of persons and remains in territorial subdivisions of bodies of homeland security.

15. In case of positive consideration of the applications or petitions the omission on entrance to border area according to appendix 2 to this standard is issued to physical person or the representative of the legal entity. Omissions are issued to them after verification of identity documents of physical person or confirming powers of the representative of the legal entity, on receipt in the book of accounting of the issued omissions on entrance to border area according to appendix 6 to this standard. The omission on entrance to border area is issued to one certain settlement.
16. The basis for refusal in issue of the omission on entrance to border area is submission of the incomplete list of the documents necessary for entrance to border area.
17. Activities of divisions of migratory police are performed on the principles of politeness, submission of exhaustive information, ensuring safety of documents, protection and confidentiality of information on contents of documents of the consumer.
18. Results of work of divisions of migratory police are measured by indicators of quality and efficiency according to appendix 7 to this standard.
19. Target measure values of quality and efficiency of the state services on which work of divisions of migratory police is estimated affirm the order of the Minister of Internal Affairs of the Republic of Kazakhstan.
20. Information on procedure for appeal of results of the state service can be obtained in the secretariat of DVD to the addresses specified in appendix 1 to this standard, the Ministry of Internal Affairs.
21. In case of disagreement with results of the rendered state service, the consumer makes the complaint in the Ministry of Internal Affairs to the address: city of Astana, Ulitsa Teuyels_zd_k, 1/1, phone 71-51-31.
22. In cases of incorrect servicing, the claim is submitted addressed to the Minister of Internal Affairs of the Republic of Kazakhstan to the address: Astana, Ulitsa Teuyels_zd_k, 1, phone 8(7172) 71-40-10, the fax 8(7172) 37-06-01, in the working days from 9:00 till 18:30 o'clock, with lunch break from 13:00 till 14:30 o'clock.
23. In disagreement cases with results of the rendered state service, the consumer can take a legal action in the procedure established by the legislation.
24. The claim is accepted in writing in any form by mail, e-mail or purposely through offices of DVD, the Ministry of Internal Affairs.

25. The accepted claim is registered in register of information of law-enforcement body.
