About approval of the Procedure for putting down of apostille in the Ministry of Justice of Ukraine on official documents, held for use in the territory of other states, and preparation by the Ministry of Justice of Ukraine of notarially processed documents for further consular legalization

According to subitems 62, 63 items 4 of the Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 395, ORDER:

1. Approve the Procedure for putting down of apostille in the Ministry of Justice of Ukraine on official documents, held for use in the territory of other states, and preparation by the Ministry of Justice of Ukraine of notarially processed documents for further consular legalization which is applied.

3. To department of notariate, bankruptcy and functioning of the central zaveritelny body (Chizhmar K. I.) provide this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

4. To department of notariate, bankruptcy and functioning of the central zaveritelny body (Chizhmar K. I.) provide proper accomplishment of this order.

5. This order becomes effective from the date of its official publication and is applied since October 1, 2012.

Procedure for putting down of apostille in the Ministry of Justice of Ukraine on official documents, held for use in the territory of other states, and preparation by the Ministry of Justice of Ukraine of notarially processed documents for further consular legalization

1. This Procedure is developed for the purpose of implementation of Rules of putting down of apostille on official documents, held for use in the territory of other states approved by the order of the Ministry of Foreign Affairs of Ukraine, the Ministry of Education and Science of Ukraine, the Ministry of Justice of Ukraine of December 5, 2003 No. 237/803/151/5, registered in the Ministry of Justice of Ukraine on December 12, 2003 for No. 1151/8472, and Instructions about procedure for consular legalization of official documents in Ukraine and abroad approved by the order of the Ministry of Foreign Affairs of Ukraine of June 4, 2002 No. 113, of Ukraine registered in the Ministry of Justice on June 26, 2002 for No. 535/6823.

2. This Procedure determines the procedure of putting down of apostille in the Ministry of Justice of Ukraine on documents which are issued by judicial authorities and courts, and also on documents which are processed by notaries of Ukraine, and preparation by the Ministry of Justice of Ukraine of notarially processed documents for further consular legalization.

The paragraph two is excluded according to the Order of the Ministry of Justice of Ukraine of 21.07.2014 No. 1176/5

3. The procedure of putting down of apostille includes:

documents acceptance and registration of a statement;

examination whether the submitted documents are subject to putting down of apostille and whether there are no bases for refusal;

reconciliation of compliance of the signature and quality in which person which signed the document and also the impresses of a seal and/or stamp which are put down on the document, to samples that available in cases of the Ministry of Justice of Ukraine or were requested according to Item 13 of this Procedure from acted;

receipt of the document on introduction of payment for putting down of apostille or the original, or the copy of the document confirming the right to exemption, certified in accordance with the established procedure;

putting down of apostille if documents conform to the requirements specified in this Item;

document registration on which the apostille is put down.

4. In putting down of apostille on the document refuses if:

the document intends for use in the country which did not join the Convention which cancels the requirement of legalization of foreign official documents, in 1961 (further - the Convention) or is participant of the Convention, but stated objection against accession of Ukraine according to article 12 of the Convention;

the text of the document cannot be read as a result of damage;

the document is written or signed pencil or is received through means of fax connection;

in the document there are not stipulated corrections or dopisk;

The Ministry of Justice of Ukraine has no powers on putting down of apostille on this document;

the signature of person which signed the document, impress of a seal and/or stamp do not answer the specimen signatures which are available in the Ministry of Justice of Ukraine, impress of a seal and/or stamp on the document.

5. The procedure of preparation of notarially processed documents for further consular legalization includes:

documents acceptance and registration of a statement;

examination whether the document of further consular legalization is subject and whether there are no bases for refusal;

reconciliation of compliance of the signature of the notary, and also the impress of a seal and/or stamp which is put down on the document, to samples that available in cases of the Ministry of Justice or were requested according to Item 13 of this Procedure from;

putting down of the stamp certifying authenticity of the previous signature of the state or private notary authorized according to the law to make notarial actions, and authenticity of print of official stamp of office of notary public or the private notary if documents conform to the requirements specified in this Item;

document registration for further consular legalization.

6. In preparation for further consular legalization refuses if:

the text of documents cannot be read as a result of damage;

documents are written or signed pencil;

documents are received through means of fax connection;

in documents several languages at the same time are used;

the documents stated on two and more single sheets are not stitched, and sheets are not numbered and not fastened by the sign and seal;

The Ministry of Justice of Ukraine has no powers for preparation of documents for further consular legalization;

the signature of person which signed the document, impress of a seal and/or stamp do not answer the specimen signatures which are available in the Ministry of Justice of Ukraine, impress of a seal and/or stamp on the document.
