1. Approve the enclosed Rules of work on stocking of reservoirs, acclimatization of new species of fish, fishery melioration of water objects.

2. Declare invalid the order of the Minister of Agriculture of the Republic of Kazakhstan of April 26, 2010 No. 290 "About approval of Rules of introduction of animals, works on stocking of reservoirs, acclimatization of new species of fish, fishery melioration of water objects" (registered in the Register of state registration of regulatory legal acts for No. 6244, No. published in the Collection of acts of the central executive and other central state bodies of the Republic of Kazakhstan 15, 2010).

3. To provide to committee of fishery of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after its first official publication.

Rules of work on stocking of reservoirs, acclimatization of new species of fish, fishery melioration of water objects

1. General provisions

1. These rules of work on stocking of reservoirs, acclimatization of new species of fish, fishery melioration of water objects (further - Rules) are developed according to subitem 51-11) of Item 1 of article 9 of the Law of the Republic of Kazakhstan on July 9, 2004 "About protection, reproduction and use of fauna" (further - the Law) and determine procedure for work by stocking, acclimatization of new species of fish, fishery melioration of water objects.

2. The terms used in these rules:

1) mowing of excessive vegetation - mechanical destruction of excessive vegetation (bevelling, damage of root system, short-term drainage of overgrown sites);

2) the current melioration - complex of the technical and operational biological actions which are resulting in short-term positive result and not requiring capital costs (rescuing of juveniles, prevention of zamor);

3) biological reasons - the evidence-based conclusion on use of fauna, determination of admissible amount of withdrawal of objects of fauna, and also on the activities capable to affect objects of fauna and the circle of their dwelling;

4) stocking of reservoirs - release of fish stock and fish in reservoirs and (or) sites for the purpose of creation of self-replicating populations, preserving valuable, rare and endangered species of fishes and (or) receipt of products;

5) biological melioration - the package of measures providing goal achievement by means of biological actions;

9) zamoroopasny reservoir and (or) the site - the fishery reservoir and (or) the site subject to periodic zamor;

10) rescuing of fishes from zamoroopasny reservoirs - complex of hydrotechnical and other measures for non-admission of death of fishes, by catching and transportation in permanent reservoirs, or connection by their channels;

11) ensuring pass of fishes to spawning areas - system of hydrotechnical and other measures (dredging, mowing of vegetation, maintenance of the urovenny mode) on ensuring rise to the rivers of producers of through passage and fishes semi-through passage;

12) protection of fishes against death in water intaking constructions - system of technical measures for prevention of death of fishes in water intakes of the different types provided at stage of their designing;

18) fishery melioration of water objects - complex of the actions directed to preserving and increase in ryboproduktivnost of reservoirs, improvement of conditions of dwelling and reproduction of fish resources and other water animals;

19) improvement of water security of reservoirs - complex of hydrotechnical and other measures for maintenance and improvement of conditions of dwelling and reproduction of water animals (chemical composition of water, pro-accuracy, the urovenny mode);

20) recovery of natural spawning areas - complex of the technical measures promoting flood of earlier lost spawning areas, prevention of their instruction, cleaning from сплавин and other deposits, to providing the normal water mode during spawning;

21) installation of artificial spawning areas - action for support of natural reproduction in reservoirs with adverse conditions of reproduction by installation of artificially made spawning areas and recovery of spawning substrate;

22) cleaning of tonevy sites - system of technical measures for ensuring safe and effective trade by removal сплавин, the flooded trees and bushes, building constructions and materials, vehicles;

23) Tonja (tonevy the site) - the section of the river and other flowing reservoir with the limited water water area of reservoir and adjacent shore intended and adapted for needs of trade fishery;
