About the Tax Committee under the Government of the Republic of Tajikistan

Establish the extreme number of employees of the Tax Committee under the Government of the Republic of Tajikistan in number of 1843 units (without service personnel) from which 1755 units are financed by means of the republican budget and 88 units at the expense of special means of Committee, including Central office of 225 units from which 165 units are financed by means of the republican budget and 60 units at the expense of special means of Committee.
3. Under the Government of the Republic of Tajikistan and its territorial structures to perform financing of the Tax Committee at the expense of means of the republican budget and special means.
4. Grant the right to the Tax Committee under the Government of the Republic of Tajikistan to have 5 vice-chairmen, including the One first Deputy Chairman and board in number of 9 people.
5. Establish for the Tax Committee under the Government of the Republic of Tajikistan limit of office automobile cars in the number of PO of units, including for Central office in number of 15 units.
6. To the Tax Committee under the Government of the Republic of Tajikistan in two-month time:
- provide to the Government of the Republic of Tajikistan offers on modification and amendments to regulatory legal acts of the Republic of Tajikistan;
- provide the decisions according to this resolution.
7. Recognize invalid the following decisions of the Government of the Republic of Tajikistan:
- of November 30, 2007, No. 602 "About modification and amendments in the order of the Government of the Republic of Tajikistan of December 28, 2006, No. 607";
- of May 28, 2009, No. 327 "About modification and amendments in the order of the Government of the Republic of Tajikistan of December 28, 2006, No. 607";
- of December 30, 2010, No. 713 "About modification and amendments in the order of the Government of the Republic of Tajikistan of December 28, 2006, No. 607";
- of November 2, 2011, No. 567 "About modification and amendments in the order of the Government of the Republic of Tajikistan of December 28, 2006, No. 607".

2. The committee in the activities is guided by the Constitution of the Republic of Tajikistan, the Tax code of the Republic of Tajikistan, other regulatory legal acts of the Republic of Tajikistan recognized by Tajikistan the international legal acts, and also this Provision.
3. The main functions of Committee are ensuring execution and observance of the tax legislation, development of mechanisms of tax administration for the purpose of ensuring timely and complete receipt of taxes in the relevant budgets, participation in preparation of drafts of the laws and other regulatory legal acts for the tax matters, including contracts with other states, explanation to taxpayers of their rights and obligations and timely informing taxpayers on changes of the tax legislation.
4. The single system of tax authorities of the Republic of Tajikistan is formed by the Central office, the Scheme of management and the List of the companies (organizations) of system of the Tax Committee under the Government of the Republic of Tajikistan approved by the Government of the Republic of Tajikistan.
5. The committee provides practical realization of functions of tax authorities in the Republic of Tajikistan and in the cases established by regulatory legal acts of the Republic of Tajikistan, outside the Republic of Tajikistan, performs management of system of tax authorities of the Republic of Tajikistan and is accountable to the Government of the Republic of Tajikistan.
6. The committee performs the activities directly or through the territorial authorities in interaction with other central and local authorities of the government, the companies, organizations, the organizations irrespective of their patterns of ownership and organizationally - legal form.
7. The committee according to established procedure performs the following powers in the sphere of the activities:
a) submits for consideration of the Government of the Republic of Tajikistan projects of regulatory legal acts of the Republic of Tajikistan on questions, stipulated in Item 1 this provision;
b) in pursuance of the Constitution of the Republic of Tajikistan, the Tax code of the Republic of Tajikistan, other regulatory legal acts of the Republic of Tajikistan develops and adopts the regulatory legal acts in the established field of activity carried to competence of Committee;
c) will organize and coordinates activities of territorial tax authorities for execution of the functions assigned to them;
d) performs state registration of legal entities, individual entrepreneurs of branches and representations of foreign legal entities, provides maintaining the Unified state register and access to its information;
e) exercises control and supervision of correctness of calculation, completeness and timeliness of introduction of taxes and other, obligatory payments in the relevant budget by physical persons and legal entities;
