About approval of the Regulations on the list and requirements concerning form and content of documents which are filed for receipt of the license for carrying out separate types of activity in the field of use of nuclear energy

According to article 12 of the Law of Ukraine "About allowing activities in the field of use of nuclear energy" I order:

1. Approve Regulations on the list and requirements concerning form and content of documents which are filed for receipt of the license for carrying out separate types of activity in the field of use of nuclear energy which is applied.

2. To provide to legal department (Matveev V. G.) submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective since October 1, 2012.

4. I reserve control over the implementation of this order.

Regulations on the list and requirements concerning form and content of documents which are filed for receipt of the license for carrying out separate types of activity in the field of use of nuclear energy

1. This Provision determines the list of documents which are provided by the subject of activities in the field of use of nuclear energy for receipt of licenses for maintaining separate types of activity in the field of use of nuclear energy, renewal, modification of current licenses or issues of the duplicate, and also the requirement concerning their registration and content.

2. The separate types of activity in the field of use of nuclear energy which are subject to licensing are determined by article 7 of the Law of Ukraine "About allowing activities in the field of use of nuclear energy".

3. For obtaining (renewal, modification) licenses, issues of the duplicate of the license for carrying out separate types of activity in the field of use of nuclear energy the subject of activities in the field of use of nuclear energy (daleezayavitel) submits to Gosatomregulirovaniye of Ukraine or its territorial authority the statement in the form established in appendix 1 to this Provision.

4. Are enclosed to the application:

copies of the constituent documents (the charter or provision) certified in accordance with the established procedure;

the documents confirming possibility of the applicant to adhere to conditions of carrying out the declared type of activity, and also the confirming compliance of financial, material, other resources, organizational structure and personnel of the applicant, to the requirements established by regulations and rules on nuclear and radiation safety in the amount necessary for its providing (in case of renewal or modification of the license if such documents were filed to body which granted the license, and affects the moment of submission of the statement, it is enough to applicant to refer to this documents). The list of documents taking into account specific type of activity is given in appendices 2, 3 to this Provision;

the certificate of qualification of personnel of the subject of activities in the field of use of nuclear energy in the form established by appendix 4 to this Provision;

the list of sources of ionizing radiation which the applicant will use or make in the form given in appendix 5 to this Provision;

the license which is subject to renewal or to which changes are made;

documents which prove the bases for renewal or modification of the license.

5. The licensee for issue of the duplicate of the license for maintaining gives separate type of activity in Gosatomregulirovaniye of Ukraine or its territorial authority such documents:

the statement on issue of the duplicate of the license in the form given in appendix 1 to this Provision;

unsuitable for use as a result of damage the form of the license;

the document on fee concerning implementation of allowing procedures.

І. Use of sources of ionizing radiation

1.1. The report on the analysis of safety of subject to use of sources of ionizing radiation (further - III).

1.2. The installation concerning management system (installation on quality) activities for use of III regarding radiation safety developed according to regulations, rules and standards on nuclear and radiation safety.

1.3. The conclusion of state examination on radiation safety of the III projects (in case of putting into operation of new installations on III or additional III which need revaluation of level of safety).

1.4. Regulations on determination of doses of radiation of patients in case of application of III in the diagnostic purposes (including methodology and protocols concerning control of dozoformiruyushchy parameters of the equipment).

1.5. The permission issued by territorial authorities of the Public sanitary and epidemiologic service (it is applied in the presence).

1.6. The plan of emergency actions when carrying out activities for use of radio nuclide III.

1.7. The instruction concerning actions of personnel in case of radiation accident when conducting activities for use of the generating devices.
