According to article 7 of the Law of Ukraine "About rehabilitation of disabled people in Ukraine", article 30 of the Law of Ukraine "About obligatory national social insurance from labor accident and occupational disease which entailed disability", paragraph one of the subitem 1 of Item 11 of the Regulations on medico-social examination approved by the resolution of the Cabinet of Ministers of Ukraine of December 03, 2009 No. 1317, and for the purpose of reduction in compliance with the current legislation of PRIKAZYVAYU:

1. Approve the Procedure for establishment by medico-social commissions of experts of extent of permanent loss of professional working capacity as a percentage to workers to whom damage is caused the health connected with accomplishment of labor obligations and Criteria of establishment by medico-social commissions of experts of extent of permanent loss of professional working capacity as a percentage to workers to whom damage the health connected with accomplishment of labor obligations is caused (are applied).

2. Recognize invalid the order MZ of Ukraine of November 22, 1995 as No. 212 "About approval of the Procedure for establishment by medico-social commissions of experts of extent of loss of professional working capacity as a percentage to workers to whom damage the health connected with accomplishment of labor obligations", registered in the Ministry of Justice of Ukraine on March 22, 1996 for No. 136/1161, and the order MZ of Ukraine of August 05, 1998 No. 238 "About approval of Criteria of establishment of extent of permanent loss of professional working capacity as a percentage of features of employment of patients and disabled people and modification and amendments in the Procedure for establishment of extent of loss of professional working capacity as a percentage approved by the order of the Ministry of Health of 22.11.95 No. 212", registered in the Ministry of Justice of Ukraine on October 14, 1998 for No. 652/3092 is caused.

3. To the Minister of Health of the Autonomous Republic of Crimea, chiefs of head departments (managements) of health care of the regional, Kiev and Sevastopol city public administrations to take into consideration and to management the presents the Procedure and Criteria.

4. To the head of department of medico-social examination (Marunich V. V.):

4.1. Provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

4.2. Establish constant control behind use by medico-social commissions of experts of the Procedure and Criteria of establishment of extent of permanent loss of professional working capacity as a percentage to workers to whom damage the health connected with accomplishment of labor obligations is caused.

5. The order becomes effective from the date of official publication.

Procedure for establishment by medico-social commissions of experts of extent of permanent loss of professional working capacity as a percentage to workers to whom damage the health connected with accomplishment of labor obligations is caused

I. General provisions

1.1. This Procedure regulates the mechanism of establishment by medico-social commissions of experts of extent of permanent loss of professional working capacity as a percentage to workers to whom damage the health connected with accomplishment of labor obligations is caused.

1.2. In this Procedure terms are used in such value:

qualification - the level of readiness, skill, degree of readiness for accomplishment of work on certain specialty or position which is determined by the category, class or other certification categories;

Other terms in this Procedure are used in the values given in the Laws of Ukraine "About rehabilitation of disabled people in Ukraine" and "About obligatory national social insurance from labor accident and occupational disease which entailed disability".

1.3. Obligations of medico-social commissions of experts (further - MSEK) are determined by the Regulations on medico-social examination approved by the resolution of the Cabinet of Ministers of Ukraine of December 03, 2009 No. 1317.

1.4. Medico-social examination of the victim is performed by MSEK as a part of the commission according to Item 10 of the Regulations on medico-social examination approved by the resolution of the Cabinet of Ministers of Ukraine of December 03, 2009 No. 1317, in the presence:

the act of the accident connected with production, in form N - 1, given in appendix 4 to the Procedure for conducting investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of November 30, 2011 No. 1232 (further the Procedure);
