1. Approve Regulations on licensing of activities for production and realization of the printed material protected from counterfeits.

2. Recognize invalid:

Item of 32 changes which are made to acts of the Government of the Russian Federation concerning the state control (supervision), approved by the order of the Government of the Russian Federation of April 21, 2010 No. 268 (The Russian Federation Code, 2010, No. 19, the Art. 2316);

Item of 31 changes which are made to orders of the Government of the Russian Federation concerning the state fee, approved by the order of the Government of the Russian Federation of September 24, 2010 No. 749 (The Russian Federation Code, 2010, No. 40, the Art. 5076).

Regulations on licensing of activities for production and realization of the printed material protected from counterfeits

1. This Provision determines procedure for licensing of activities of legal entities and individual entrepreneurs for production and realization of the printed material protected from counterfeits.

2. In this Provision the following concepts are used:

"the printed material protected from counterfeits" - the printed material containing at least two protective elements, made using the printing, holographic, information, microprocessor and different ways of protection of printed material preventing counterfeit of these products;

"production of the printed material protected from counterfeits" - the finished cycle of printing works including development of the prototype, production of photoforms and printing forms, seal and finishing of products with use of highly protected hard to reproduce production technologies of protective elements, information on which is confidential, drawing numbering, and also accounting of the made printed material protected from counterfeits at all stages of its production and storage;

"realization of the printed material protected from counterfeits" - sale of the printed material protected from counterfeits by the licensee manufacturer to the customer.

3. Licensing of activities for production and realization of the printed material protected from counterfeits (further - the licensed type of activity) is performed by the Federal Tax Service (further - the licensing body).

4. The licensed requirements imposed to the license applicant (licensee) when implementing of the licensed type of activity are:

a) availability at the license applicant (licensee) in the place of implementation of the licensed type of activity belonging to it on the property right or on other legal cause of the rooms isolated from rooms in which other printed material, processing equipment, and also the technical documentation providing the finished cycle of production of the printed material protected from counterfeits is made (further - the protected products);

b) availability at the license applicant of conditions for accomplishment of the requirements to the mode of protection of the rooms used for implementation of the licensed type of activity and to accounting of the protected products approved by the Ministry of Finance of the Russian Federation, and also observance by the licensee of the specified requirements;

c) availability at the license applicant (licensee) of conditions for accomplishment of the technical requirements approved by the Ministry of Finance of the Russian Federation to production of the protected products and conditions of its production, and also observance by the licensee of the specified requirements and conditions;

d) availability in staff of the license applicant (licensee) of the specialists having the higher or secondary professional education in the field of design (graphical design), technology of printing production, printing production and length of service in at least 5 years;

e) availability at the license applicant (licensee) of the automated systems processing confidential information and also the remedies of such information which underwent assessment procedure of compliance according to the legislation of the Russian Federation;

e) availability at the license applicant (licensee) of copyright of programs for electronic computers and the database which will be used for production of the protected products, or license agreements about provision of right to use of such programs and databases.

5. Implementation of the licensed type of activity with gross violation of licensed requirements involves the responsibility established by the legislation of the Russian Federation. At the same time gross violation is understood as the failure to carry out by the licensee of the requirements provided by subitems "b", "v" and "d" of item 4 of this provision, which entailed the effects provided by part 11 of article 19 of the Federal law "About Licensing of Separate Types of Activity".

6. For receipt of the license the license applicant directs (submits) the application for provision of the license and documents (the copy of documents) specified in part 1 and Items 1 and 4 of part 3 of article 13 of the Federal law "About Licensing of Separate Types of Activity" in the licensing body and also:

a) copies of the documents confirming qualification of workers of the license applicant;

b) copies of documents or certified by the signature of the head or the official authorized on that and seal of the license applicant (in the presence of seal) statements from documents which confirm length of service of workers of the license applicant in at least 5 years;

c) the instruction on the mode of protection of the rooms used for implementation of the licensed type of activity, and to accounting of the protected products (with appendix of forms of accounting of the specified products, schemes of the security and fire alarm, schemes of arrangement of posts of protection with their description), approved by the head of the license applicant;

d) the documents signed by the head or the official authorized on that and certified by seal the license applicant (in the presence of seal), the protection containing the description of elements and specifying of level of security of the product samples made by the license applicant, with appendix of the specified samples (6 copies of each sample);

e) copies of the documents confirming passing with the automated systems processing confidential information and also remedies of such information of assessment procedure of compliance according to the legislation of the Russian Federation;
