PRESIDENTIAL DECREE OF THE AZERBAIJAN REPUBLIC

About approval of the Regulations on system of interdepartmental electronic document management

(as amended on 29-12-2023)

Being guided by Item 32 of article 109 of the Constitution of the Azerbaijan Republic, according to subitem 7.2.4.2 of "The state program on development of communication and information technologies in 2010-2012 (Electronic Azerbaijan)", the President of the Azerbaijan Republic approved by the Order of August 11, 2010 1056, for the purpose of creation of electronic document management system between state bodies I decide No.:

1. Approve "Provision on system of interdepartmental electronic document management" it (is applied).

2. In a month to provide to Administration of the President of the Azerbaijan Republic to Special service of the state protection of the Azerbaijan Republic for acceptance of necessary measures summarized information on demand for providing with technical means in nodes of participants of system of interdepartmental electronic document management, about heads and deputy managers of these participants to whom the digital signature, and also about responsible persons who will directly perform electronic document management will be provided.

3. To provide to the Cabinet of Ministers of the Azerbaijan Republic within fifteen days based on the appeal of Special service of the state protection of the Azerbaijan Republic allocation of the financial resources necessary for providing participants of system of interdepartmental electronic document management with technical means of nodes.

4. To special service of the state protection of the Azerbaijan Republic till July 1, 2013 to finish process of providing with technical means of nodes of the participants provided by subitems 1.3. 1, 1.3.2 and 1.3.4, and till January 1, 2013 the participants provided by subitems 1.3.3 "Provisions on system of the interdepartmental electronic document management" approved by this Decree and to inform on it Administration of the President of the Azerbaijan Republic.

5. To participants, stipulated in Item 1.3.1 of "Provision on system of the interdepartmental electronic document management" approved by this Decree since July 1, 2013, and to participants, stipulated in Item 1.3.3, since January 1, 2014 to provide the beginning of electronic document management.

6. To the participants provided by the Items 1.3.2 and 1.3.4 "Regulations on System of Interdepartmental Electronic Document Management", approved by this Decree to recommend to begin electronic document management since July 1, 2013.

Regulations on system of interdepartmental electronic document management

1. General provisions

1.1. This Provision is prepared according to subitem 7.2.4.2 of "The state program on development of communication and information technologies in 2010-2012 (Electronic Azerbaijan)", the President of the Azerbaijan Republic approved by the Order of August 11, 2010 No. 1056, and establishes rules of creation of system of interdepartmental electronic document management (further - system), its managements and use.

1.2. The organizer of system is the Administration of the President of the Azerbaijan Republic, the operator - Public service of special communication and information security of the Azerbaijan Republic.

1.3. Participants of system are:

1.3.1. state bodies;

1.3.2. the legal entities who are in property of the state and which shares are controlled by the state, the public legal entities created on behalf of the state;

1.3.3. the organizations provided by the list attached to this Provision.

1.4. In this Provision the electronic document management is understood as exchange of electronic documents between participants of system and accounting of movement of documents in system.

1.5. This Provision does not extend to turnover of information containing the state secret.

1.6. Basic principles of system:

1.6.1. technical capability of use of system at the same time several participants;

1.6.2. use by participants of system of technologies, formats, protocols and program technical means which can be approved among themselves;

1.6.3. use by participants of system only the certified software and program technical means;

1.6.4. ensuring integrity of data;

1.6.5. ensuring information security in case of interdepartmental electronic document management;

1.6.6. implementation of the clerical work connected with electronic documentation according to "The instruction for record keeping in public authorities, organizations, the organizations and at the companies", the Azerbaijan Republic approved by the Presidential decree of September 27, 2003 No. 935.

2. Technical-technological infrastructure of system

2.1. Technical-technological infrastructure of system consists of the following elements:

2.1.1. main node of system;

2.1.2. nodes of participants of system;

2.1.3. secure channels of communication.

2.2. The system of document flow, e-mail servers, software and hardware of the certified center, means of information protection, the software of interaction of participants of system and other programmnotekhnichesky means belong to technical means of the main node of system.

2.3. The communication equipment, means of information protection and the automated workplaces belong to technical means of nodes of participants of system the server (including the reserve server).

2.4. Technical means of nodes of participants of system are provided by the system operator for temporary use gratuitously. Transfer of technical means is drawn up by the delivery and acceptance certificate. Technical means shall be placed in the rooms providing their protection, and also safety of the directed and accepted documents.

2.5. In case of need placements of additional technical means in nodes of participants of system and (or) change of their location the complex of works on carrying out communication lines, purchase of the equipment and the software is performed by the system operator by financial means of the participant of system.

3. Orgnizator of system

3.0. Main functions of the organizer of system:

3.0.1. exercise control over the implementation of requirements of the legal acts regulating ensuring document flow within system, and also information security, in case of violation of the specified requirements to prohibit or stop electronic document management;

3.0.2. be informed on the leading faces of the system operator and the participants responsible for interdepartmental electronic document management;

3.0.3. perform organizational and methodical support of system.
