PRESIDENTIAL DECREE OF THE AZERBAIJAN REPUBLIC

About approval of the Regulations on system of interdepartmental electronic document management

(as amended of the Presidential decree of the Azerbaijan Republic of 14.07.2016 No. 993)

Being guided by Item 32 of article 109 of the Constitution of the Azerbaijan Republic, according to subitem 7.2.4.2 of "The state program on development of communication and information technologies in 2010-2012 (Electronic Azerbaijan)", the President of the Azerbaijan Republic approved by the Order of August 11, 2010 1056, for the purpose of creation of electronic document management system between state bodies I decide No.:

1. Approve "Provision on system of interdepartmental electronic document management" it (is applied).

2. In a month to provide to Administration of the President of the Azerbaijan Republic to Special service of the state protection of the Azerbaijan Republic for acceptance of necessary measures summarized information on demand for providing with technical means in nodes of participants of system of interdepartmental electronic document management, about heads and deputy managers of these participants to whom the digital signature, and also about responsible persons who will directly perform electronic document management will be provided.

3. To provide to the Cabinet of Ministers of the Azerbaijan Republic within fifteen days based on the appeal of Special service of the state protection of the Azerbaijan Republic allocation of the financial resources necessary for providing participants of system of interdepartmental electronic document management with technical means of nodes.

4. To special service of the state protection of the Azerbaijan Republic till July 1, 2013 to finish process of providing with technical means of nodes of the participants provided by subitems 1.3. 1, 1.3.2 and 1.3.4, and till January 1, 2013 the participants provided by subitems 1.3.3 "Provisions on system of the interdepartmental electronic document management" approved by this Decree and to inform on it Administration of the President of the Azerbaijan Republic.

5. To participants, stipulated in Item 1.3.1 of "Provision on system of the interdepartmental electronic document management" approved by this Decree since July 1, 2013, and to participants, stipulated in Item 1.3.3, since January 1, 2014 to provide the beginning of electronic document management.

6. To the participants provided by the Items 1.3.2 and 1.3.4 "Regulations on System of Interdepartmental Electronic Document Management", approved by this Decree to recommend to begin electronic document management since July 1, 2013.

Regulations on system of interdepartmental electronic document management

1. General provisions

1.1. This Provision is prepared according to subitem 7.2.4.2 of "The state program on development of communication and information technologies in 2010-2012 (Electronic Azerbaijan)", the President of the Azerbaijan Republic approved by the Order of August 11, 2010 No. 1056, and establishes rules of creation of system of interdepartmental electronic document management (further - system), its managements and use.

1.2. The organizer of system - Administration of the President of the Azerbaijan Republic, the operator - Special service of the state protection of the Azerbaijan Republic.

1.3. Participants of system are the following state bodies and the organizations:

1.3.1. Administration of the President of the Azerbaijan Republic, Administration of the President of the Azerbaijan Republic, Special health service of the President of the Azerbaijan Republic, offices of the Cabinet of Ministers of Azerbaijan, the Cabinet of Ministers of the Nakhchivan Autonomous Republic, the central executive bodies of the Azerbaijan Republic and the bodies equated to them, executive bodies under the Cabinet of Ministers of the Azerbaijan Republic and the Highest certifying commission in case of the President of Azerbaijan, the Central bank of the Azerbaijan Republic, the Secretariat of Tariff (price) council of the Azerbaijan Republic;

1.3.2. Millie's devices of Majlis of the Azerbaijan Republic, the Constitutional court of the Azerbaijan Republic, the Supreme Court of the Azerbaijan Republic, the Supreme Council of the Nakhchivan Autonomous Republic, Audit Chamber, Judicial and legal council of the Azerbaijan Republic, the Commissioner for Human Rights of the Azerbaijan Republic (Ombudsman), Central Election Commission of the Azerbaijan Republic and National council on television and broadcasting, the Prosecutor General's Office of the Azerbaijan Republic, the secretariat of the Commission on fight against corruption of the Azerbaijan Republic;

1.3.3. local executive bodies;

1.3.4. the organizations provided in the list attached to this Provision.

1.4. Document flow in this Provision is understood as the following information processes connected with the ordered movement of electronic documents between participants of system:

1.4.1. direction of acts and orders (recommendations) of the President of the Azerbaijan Republic and Cabinet of Ministers of the Azerbaijan Republic electronically;

1.4.2. direction electronically information on results of consideration of electronic documents, including orders (recommendations) of the President of the Azerbaijan Republic and Cabinet of Ministers of the Azerbaijan Republic, participants of system;

1.4.3. representation by participants of system of addresses, and also drafts of legal acts to the President of the Azerbaijan Republic and to the Cabinet of Ministers of the Azerbaijan Republic electronically;

1.4.4. implementation electronically reconciliation procedures according to drafts of legal acts between participants of system.

1.5. This Provision does not extend to turnover of information containing the state secret.

1.6. Basic principles of system:

1.6.1. technical capability of use of system at the same time several participants;

1.6.2. use by participants of system of technologies, formats, protocols and program technical means which can be approved among themselves;

1.6.3. use by participants of system only the certified software and program technical means;

1.6.4. ensuring integrity of data;

1.6.5. ensuring information security in case of interdepartmental electronic document management;
