Approve the Procedure for forming of the state order on release of publishing products and its distribution which is applied.

Procedure for forming of the state order on release of publishing products and its distribution

1. This Procedure determines the mechanism of forming of the state order on release of publishing products (the dalshegosudarstvenny order) and its distribution.

Action of this Procedure does not extend to forming of the state order on release of textbooks and benefits for providing students of higher educational institutions, pupils of general education and professional educational institutions and pupils of preschool educational institutions and their distribution.

2. The purpose of this Procedure is determination of the basic organizational and economic principles of forming of the state order, regulation of relations between customers and contractors, providing the transparent mechanism of forming of high-quality and substantial filling of range of domestic publishing production for satisfaction of information, educational and cultural requirements of the Ukrainian society, assistance to forming of positive international image of the state.

3. The state order is performed on purpose:

1) assistance:

to development of domestic book publishing for increase in its level on quantitative and qualitative indexes to the level of the leading states of the world;

to the edition of works of classics of the Ukrainian literature and modern writers;

to the translation of works of the Ukrainian authors on foreign languages for ensuring representation of domestic publishing production and its promoting abroad;

to the maximum satisfaction of cultural and educational requirements of the population of Ukraine and Ukrainians abroad in domestic publishing production;

2) replenishments of library stocks of Ukraine publishing products;

3) increases in interest in reading, education of culture of reading and love to the printing word;

4) ensuring access to property of world culture by the translation and the edition in state language of works of outstanding foreign authors.

4. The central executive bodies, other state bodies, organizations and the organizations which are potential state customers on release of publishing products for the state requirements (further - potential state customers) determine subject of editions which are provided to release according to the state order, and prepare offers in the draft of the state order.

5. For preparation of offers in the draft of the state order potential state customers announce information on acceptance from publishers of offers concerning release on the state order of editions of certain subject (further - offers) and terms of their representation.

In offers are specified:

information about authors and other persons who will take part in creation of the edition;

the name of the edition with the short summary;

languages in which it is offered to issue the edition;

edition amount (it is specified in publisher's and conditional printed pages);

edition circulation;

condition of preparation of the edition for release;

estimated cost of circulation of the edition.

6. Such documents are attached to offers:

technical parameters;

planned expense budget;

the original or the notarized copy of the document (documents) which confirms availability at the publisher of exclusive property right on use of the work;

copy of the certificate on entering of the publisher into the State register of Ukraine publishers, manufacturers and distributors of publishing products or its duplicate;

documents which confirm solvency of the publisher.

7. Potential state customers based on the offers accepted from publishers perform preliminary selection of editions for release according to the state order.

8. Thematic and substantial assessment of the editions which are previously selected by potential state customers is performed by the advisory councils formed by them.

Advisory councils are consultative, permanent advisory collegiate organs which part representatives of scientific institutions, creative unions, libraries, book-trade and printing the companies, public organizations and so forth can be.

Advisory councils operate on principles of collective leadership and impartiality of the members. Membership in advisory council shall not create contradictions between interests of potential state customers and publishers, and also to influence objectivity and impartiality of decision making concerning the choice of editions.

9. Taking into account conclusions of advisory councils potential state customers prepare offers in the draft of the state order the next year.

10. The draft of the state order is created the Ministry of Economics together with potential state customers according to the procedure determined by the legislation.

11. After approval of the Government budget of Ukraine for the corresponding year, determination and approval of amounts and structure of the state order the central executive bodies, state bodies, organizations and the organizations which for the corresponding year provides funds for release of publishing products (further - the state customers) submit for consideration of advisory councils lists of editions which are provided to release according to the state order in the current year (further - lists), and taking into account conclusions of advisory councils approve them in the procedure established by the legislation.

Such lists join editions which cover hot topics in the context of modern problems of creation of the state and history of Ukraine, promote cultural, educational and scientific development of the personality, education of children and youth, strengthening of scientific and technical and investment potential of the state, integration of Ukraine into the European and world commonwealth, satisfy reader's demand according to data of libraries of Ukraine, and also the editions devoted to memorials.

The approved lists will be promulgated on official websites of the state customers, in official printing publications, at information stands or any other method.

12. The state customers, proceeding from the approved amounts of the state order and funds allocated for their accomplishment independently perform the choice of contractors of the state order according to the procedure, established by the Law of Ukraine "About implementation of public procurements".
