About approval of the Payment procedure of work of members district and precinct election commissions at elections of People's Deputies of Ukraine

Approve the Payment procedure of work of members district and precinct election commissions at elections of People's Deputies of Ukraine which is applied.

Payment procedure of work of members district and precinct election commissions at elections of People's Deputies of Ukraine

1. The chairman, the vice-chairman, the secretary or other members district or the precinct election commission at elections of People's Deputies of Ukraine (further - the electoral commission) (total quantity it is no more than three persons) according to the decision of the electoral commission during the period of powers of the electoral commission or part of this period can perform the powers on paid basis according to part six of article 36 of the Law of Ukraine "About elections of People's Deputies of Ukraine" based on the agreement on accomplishment of obligations of the member of the electoral commission at elections of People's Deputies of Ukraine imprisoned with district electoral commission in form according to appendix 1.

The chairman, the vice-chairman, the secretary or other members of the precinct election commission of the foreign polling precinct (total quantity it is no more than three persons) according to the decision of the electoral commission which affirms Central Election Commission during the period of powers of the electoral commission or part of this period can perform the powers on paid basis based on the agreement signed with the relevant foreign diplomatic organization of Ukraine which performs financial provision of said commission for preparation and elections of People's Deputies of Ukraine.

2. For the conclusion of the civil agreement:

1) the member of the electoral commission who is, in particular, physical person entrepreneur, the pensioner, person who temporarily does not work, person recognized in the procedure established by the law as the unemployed, or person exempted from accomplishment of production or service duties on principle place of employment files such documents to district electoral commission:

the copy of pages of the passport on which surname, the name, middle name, birth date and birth place, series, passport number who and when issues the passport, mark about registration of the place of residence are entered;

the copy of the certificate of registration number of accounting card of the taxpayer (series and passport number - for physical persons which because of the religious beliefs refused adoption of such number and reported about it to relevant organ of the State Tax Service and have mark in the passport);

2) the member of the electoral commission exempted from accomplishment of production or service duties on principle place of employment submits to district electoral commission together with the documents specified in subitem 1 of this Item also such documents:

the certificate of release from accomplishment of production or service duties on principle place of employment;

the reference from principle place of employment on the average salary which size is calculated according to the Procedure for calculation of the average salary approved by the resolution of the Cabinet of Ministers of Ukraine of February 8, 1995 No. 100 (ZP of Ukraine, 1995, No. 4, of the Art. 111). Such reference moves the member of the electoral commission in district electoral commission within five days from the date of approval of the higher level of the decision of the electoral commission by the electoral commission on implementation of powers by it in the electoral commission on paid basis.

3. Compensation of the member of the electoral commission is performed:

person exempted from accomplishment of production or service duties on principle place of employment - based on the reference from principle place of employment on the average salary which size is calculated according to the Procedure for calculation of the average salary approved by the resolution of the Cabinet of Ministers of Ukraine of February 8, 1995 No. 100 (ZP of Ukraine, 1995, No. 4, of the Art. 111);

physical person entrepreneur, the pensioner, person who temporarily does not work, or person recognized in the procedure established by the law as the unemployed - according to the resolution of the Cabinet of Ministers of Ukraine of July 28, 2004 with No. 966 "About payment terms of work of members of the electoral commissions" (The Official Bulletin of Ukraine, 2004, No. 31, the Art. 2063).

4. Compensation of the member of the electoral commission who performs the powers in the commission on paid basis is performed once a month by district electoral commission based on the sheet of accounting of working hours, in particular by money transfer through organization of bank or post office into personal card or other account according to the statement of the member of the electoral commission. The services connected with transfer of the specified payment through organization of bank or post office are paid at the expense of means of the member of the electoral commission.

In case when the member of the electoral commission performs the powers on paid basis not complete calendar month or for various reasons there was early termination of validity about accomplishment of obligations of the member of the electoral commission, its robot is paid in proportion to worked time.

Compensation of the member of the precinct election commission of the foreign polling precinct is performed in foreign currency of the state of the location of the relevant foreign diplomatic organization of Ukraine proceeding from the official rate of hryvnia established by National Bank on date of the corresponding payments in the sizes approved by the resolution of the Cabinet of Ministers of Ukraine of July 28, 2004 No. 966 "About payment terms of work of members of the electoral commissions" (The Official Bulletin of Ukraine, 2004, No. 31, the Art. 2063).

5. Compensation of members of the electoral commissions (including that which perform powers not on paid basis) in ballot day and in days of establishment of result of vote it is performed:

for members of district electoral commissions - no more than in three days;

for members of precinct election commissions - no more than in two days.

The basis for compensation of the member of the electoral commission in ballot day and in days of establishment of result of vote is the sheet of accounting of working hours.
