About approval of the Regulations on procedure for conducting checks of members of Fund of guaranteeing household deposits

According to Item of 1 part four of Article 12, Article 32, Item 13 of the Section X "Final and transitional provisions" of the Law of Ukraine "About system of guaranteeing household deposits" executive directorate of Fund of guaranteeing household deposits of RESHILA:

1. Approve Regulations on procedure for conducting checks of members of Fund of guaranteeing household deposits which are applied.

3. To provide to department of inspection together with legal department submission of this decision to the Ministry of Justice of Ukraine for state registration.

4. This decision becomes effective at the same time with entry into force of the Law of Ukraine "About system of guaranteeing household deposits", but not earlier than day of official publication.

5. And the international organizations to provide to department of public relations placement of this decision on the official page of Fund of guaranteeing household deposits on the Internet after its state registration.

Regulations on procedure for conducting checks of members of Fund of guaranteeing household deposits

І. General provisions

1.1. This Provision is developed according to Articles 4, of 12, of 17, 32 Laws of Ukraine "About system of guaranteeing household deposits" (further - the Law), the Law of Ukraine "About banks and banking activity", other regulatory legal acts governing the relations in the sphere of accomplishment of obligations by banks in connection with their participation in system of guaranteeing household deposits.

1.2. This Provision regulates procedure for planning and carrying out by employees of Fund of guaranteeing household deposits (further - Fund) checks of banks.

1.3. The purpose of this provision is ensuring implementation by Fund of regulating activities concerning control over the implementation of obligations of banks in connection with their participation in system of guaranteeing household deposits, observance of the regulatory legal acts of Fund by banks and fulfillment of requirements established by Fund within its powers.

1.4. Objects of check from Fund are banks and their separate divisions (further - banks).

1.5. In this Provision terms are used in such value:

date of check - date for which condition performs check of bank;

remote check - remote check of bank by the inspector, inspectors of Fund

the certificate of check - the document of any form which is constituted by the inspector of Fund for results of check of single questions of the verification plan of bank;

the report on check - the document of the single form of results performed bank which is constituted by the inspector (if check was performed by one inspector) or the head of inspection team taking into account certificates of check of single questions of the verification plan;

the inspector - the employee of structural division Fonda authorized by Fund on check implementation to whose powers implementation of checks of banks is referred;
