About approval of Rules of functioning of industry design offices

1. Approve the enclosed Rules of functioning of industry design offices.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of functioning of industry design offices

1. General provisions

1. These rules of functioning of industry design offices (further - rules) are developed according to the subitem 15) of article 4 of the Law of the Republic of Kazakhstan of January 9, 2012 "About the state support of industrial and innovative activities" and determine procedure for functioning of industry design offices.

2. In these rules the following concepts and terms are used:

1) industry design office (further - experimental design bureau) - the legal entity owning material complex, created by national institute of development in the field of technology development for assistance to subjects of industrial and innovative activities in production organization of new or advanced goods;

2) the applicant - the legal entity or physical person realizing the industrial and innovative projects connected with development and deployment in production of new or advanced goods;

3) the request - the statement of the established sample with appendix of necessary documents according to requirements of these rules;

4) goods - subject or set of objects which are subject to production by the receiver as a result of rendering services of experimental design bureau;

5) engineering services - engineering and consulting services in preparation of production process and sales of products (goods, works, services), rendering preproject and project services (preparation of feasibility statements, construction work, other accompanying services);

6) infrastructure - complex of buildings, constructions, processing equipment, the opytnopromyshlenny site, vehicles;

7) testing - experimental determination of quantity and quality characteristics of properties of goods as result of impact on it;

8) design preparation of production - complex of the actions pursuing the purpose to adapt design documentation for conditions of serial production of specific manufacturer;

9) National technology development agency (further - the Agency) national institute of development in the field of technology development;

10) the receiver - the applicant whose request according to these rules is accepted for rendering services of experimental design bureau;

11) royalty - the monetary compensation for use of technical documentation, licenses, patents and other types of property in case of production paid in the form of percent from cost of goods sold which size is established by the service provision agreement of experimental design bureau signed between experimental design bureau and the receiver;

12) certification - the procedure by means of which the body for confirmation of conformity in writing certifies compliance of goods, services to the established requirements;

13) the collaborator - the physical person or legal entity having necessary resources and qualification, attracted by experimental design bureau based on the legislation of the Republic of Kazakhstan on public procurements to realization of separate actions within rendering services of experimental design bureau to the receiver;

14) technical documentation - the design, technology and regulating documentation necessary for production organization of new or advanced goods, and also their operation and repair;

15) technical training of production - complex of the normative and technical actions regulating design, technology preparation of production and system of statement of goods on production;

16) technology preparation of production - set of the works determining the sequence of accomplishment of production process of new goods by the most rational methods taking into account specific conditions of production;

17) the technology memorandum - the agreement signed by authorized body in the field of the state support of industrial and innovative activities with national managing directors of holdings, national holdings, the national companies and legal entities, affiliirovanny with them, and determining the list of the purchased goods, works and services.

18) the project - the industrial and innovative project planned to realization by the applicant or realized by the receiver in the course of rendering and with use of results of services of experimental design bureau.

3. The solution of the questions arising in the course of functioning of experimental design bureau and which are not settled by these rules is within the competence and is drawn up by decisions of the Agency.

2. Procedure for functioning of experimental design bureau

4. According to the tasks determined by the Law of the Republic of Kazakhstan "About the state support of industrial and innovative activities" experimental design bureaus render to receivers the following services (further - services of experimental design bureau):

1) acquisition (if necessary - completion, adaptation) technical documentation for production organization of goods on its basis;

2) assistance in transfer of technologies;

3) assistance in creation of new or advanced goods;

4) development of technical documentation;

5) services on technical (design and technology) production preparation;

6) consulting and engineering services;

7) assistance when carrying out testing of new or advanced products in accredited test laboratories (centers);

8) assistance when carrying out certification of new or advanced products in accredited authorized bodies.

5. If necessary, for the purpose of ensuring necessary quality and completeness of the rendered services, experimental design bureaus can involve in rendering services of collaborators.

6. Results of services of experimental design bureau depending on the needs of the receiver defined by the agreement between experimental design bureau and the receiver are:

1) technical documentation, licenses or patents for the production right;

2) prototype (batch) of products;
