3. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. 3. The authorized body in the field of environmental protection (further - authorized body) considers international standards and standards of the Republic of Kazakhstan regarding recognition and admissibility of their action in the territory of the Republic of Kazakhstan in cases:

1) conclusions Republic of Kazakhstan of the international treaty on mutual recognition of units of quotas and other carbon units;

2) appeals of physical persons and legal entities.

4. The authorized body considers international standards and standards of the Republic of Kazakhstan regarding compliance to the recognition criteria and to admissibility of action provided in Chapter 3 of these rules.

5. By results of consideration in the case provided by the subitem 1) of Item 3 of these rules, the authorized body makes offers on application of international standards and standards of the Republic of Kazakhstan as national standards, or provides data on their accounting in the register of the state system of technical regulation in the authorized state body performing state regulation in the field of technical regulation according to article 24 of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation".

6. By results of consideration in the case provided by the subitem 2) of Item 3 of these rules, the authorized body issues the letter on recognition and admissibility of action in the territory of the Republic of Kazakhstan of the international standard.

1) lack of relevant provisions in the legislation to the Republic of Kazakhstan;

2) availability of the international practice of application (in case of international standards).

8. Criteria of admissibility of action in the territory of the Republic of Kazakhstan of the international standards and standards of the Republic of Kazakhstan used in realization of project mechanisms in the field of regulation of emissions and absorption of greenhouse gases, carrying out inventory count of greenhouse gases, verification and validation are:

1) lack of contradictions to provisions and regulations of the legislation of the Republic of Kazakhstan;

2) availability of organizational and technical capabilities for their application in the territory of the Republic of Kazakhstan.
