Questions of declaring of change of wholesale selling prices on medicines and products of medical appointment which are bought at the expense of means state and local budgets

For the purpose of ensuring effective use of means state and local budgets for purchase of medicines and products of medical appointment the Cabinet of Ministers of Ukraine decides:

1. Determine that:

1) since September 1, 2012:

are subject to declaring of change of wholesale selling prices without duty and the value added tax on:

- the medicines included in the list of medicines of national and foreign production which can buy institutions and healthcare institutions which are fully or partially financed from state and local budgets, No. 1071 approved by the resolution of the Cabinet of Ministers of Ukraine of September 5, 1996 "About procedure for purchase of medicines by institutions and healthcare institutions which are financed from the budget" (ZP of Ukraine, 1996, No. 17, the Art. 480), except narcotic and psychotropic medicines, precursors, active ingredients (substances), medical gases and dosage forms which are produced in drugstores according to recipes of doctors (the main formulas) and by request of treatment-and-prophylactic institutions from allowed for use acting and excipients (further - medicines);

- products of medical appointment, namely dressing and sutural means, dental materials, sanitary and hygienic products and materials, prosthetic and orthopedic products and materials, laboratory glassware, products of-point optics, product and the materials intended for packaging and storage of medical products and medicines, sets of reagents for medical photometric, immunofermental, radio immunological and other analysis types, first-aid kits, first-aid kits clinical, products from polymeric, rubber and other materials and product which are applied in medicine except medical equipment which are included in the State register of medical equipment and products of medical appointment and are acquired fully or partially at the expense of means state and local budgets;

institution and healthcare institution which are fully or partially financed from state and local budgets, buy medicines and products of medical appointment at the prices which do not exceed the level of the declared changes of wholesale selling prices taking into account duty, the value added tax and limiting supplying and sales and trade (retail) allowances established by the resolution of the Cabinet of Ministers of Ukraine of October 17, 2008 No. 955 "About measures for price stabilization on medicines and products of medical appointment" (The Official Bulletin of Ukraine, 2008, No. 84, of the Art. 2825);

2) the wholesale selling prices entered till September 1, 2012 in the register of wholesale selling prices on medicines and products of medical appointment are considered as the declared changes of the specified prices and affect during effective period of the registration certificate appropriate means or certificates on state registration of the corresponding product.

2. Approve the Procedure for declaring of change of wholesale selling prices on medicines and products of medical appointment which are bought at the expense of means state and local budgets it (is applied).

3. Paragraph one of the subitem 2 of Item 1 of the resolution of the Cabinet of Ministers of Ukraine of October 17, 2008 No. 955 "About measures for price stabilization on medicines and products of medical appointment" (The Official Bulletin of Ukraine, 2008, No. 84, Art. 2825; 2009, No. 27, Art. 906; 2011, No. 68, Art. 2607; 2012, 11, 415) to state No. to the Art. in such edition:

take measures to introduction of monitoring of the prices of medicines and products of medical appointment which are bought at the expense of means state and local budgets;
