About approval of the Regulations on providing the right of persons to access to public information in the National commission which performs state regulation in the sphere of the markets of financial services

For the purpose of ensuring unconditional fulfillment of requirements of the Law of Ukraine "About access to public information" and the Presidential decree of Ukraine of May 05, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information", realization by citizens of the right to access to public information guaranteed by the state, the National commission which performs state regulation in the sphere of the markets of financial services, POSTANOVILA:

1. Approve Regulations on providing the right of persons to access to public information in the National commission which performs state regulation in the sphere of the markets of financial services which is applied.

2. Organizational and staffing together with legal department to provide to department submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

3. To provide to the sector of public relations and the protocol promulgation of this order after its state registration.

4. This order becomes effective from the date of its official publication.

5. Control over the implementation of this order to leave for the Chairman Natskomfinuslug.

Regulations on providing the right of persons to access to public information in the National commission which performs state regulation in the sphere of the markets of financial services

I. General provisions

1.1. This Provision determines procedure for access to public information in the National commission which performs state regulation in the sphere of the markets of financial services.

1.2. In this Provision terms are used in the values given in the Law of Ukraine "About access to public information".

1.3. Legal regulation of the relations connected with ensuring access to public information is performed according to the Laws of Ukraine "About access to public information", "About information" and "About the state secret".

1.4. Action of this provision does not extend to the relations concerning receipt of information by subjects of powers of authority when implementing of the functions by them, and also to the relations in the sphere of addresses of citizens.

1.5. Directs and coordinates provision to access to public information the chief of staff Natskomfinuslug who performs the direction, coordination of activities and control of work of structural divisions of Natskomfinuslug to which competence questions of ensuring clerical work and the organization of control according to distribution of functional obligations are carried.

1.6. The procedure for provision, accounting and systematization of requests for public information will be organized by the structural division of Natskomfinuslug responsible for ensuring access to public information (further - responsible structural division). Control concerning terms of accomplishment of requests provides the structural division responsible for control of performing discipline in Natskomfinuslug.

1.7. Heads of independent structural divisions of Natskomfinuslug who possess required information and are determined by the resolution of the chief of staff Natskomfinuslug to request, will organize and provide accomplishment and provision of public information on request.

II. Ensuring access to public information in Natskomfinuslug

2.1. Access to public information to Natskomfinuslug is provided in the way:

2.1.1. Systematic and operational promulgation of information:

in official printing publications of Natskomfinuslug;

on the official website of Natskomfinuslug on the Internet;

on the single state web portal of open data;

at information stands;

by any other method.

2.1.2. Provision of information on request for information.

2.2. Restriction of information access is performed according to part two of article 6 of the Law of Ukraine "About access to public information".

2.3. Promulgation and placement on the official site of Natskomfinuslug of the public information prepared and provided by structural divisions of Natskomfinuslug taking into account requirements of the Law of Ukraine "About access to public information" is provided with the structural division responsible for promulgation of information on activities of Natskomfinuslug.

To urgent promulgation any information on the facts, life-endangering is subject, to health and/or property of persons, and the measures applied with respect thereto.

2.4. Information and documents determined by article 15 of the Law of Ukraine "About access to public information" is subject to promulgation on the official site of Natskomfinuslug:

information on organizational structure, mission, function, powers, tasks, activities and financial resources (structure and amount of budgetary funds, procedure and mechanism of their expenditure, etc.);

regulatory legal acts, acts of individual action (except intra organizational) adopted by Natskomfinuslug, drafts of the decisions which are subject to discussion, information on the normative legal basis of activities;

procedure for creation, giving of request for information, appeals of solutions of Natskomfinuslug, actions or failure to act;

information on system of accounting, types of information which is stored by Natskomfinuslug;

the list of data sets which are published in form of open data;

information on mechanisms or procedures by means of which the public can represent the interests or otherwise influences realization of powers of Natskomfinuslug;
