About approval of Rules of addressing of real estate objects in the territory of the Republic of Kazakhstan

1. Approve the enclosed Rules of addressing of real estate objects in the territory of the Republic of Kazakhstan.

2. To department of architecture, project works and estimate norms of the Agency of the Republic of Kazakhstan for construction and housing and communal services (Turushova D. A.) and to Legal management (Kulmagambetov K. A.) The agencies of the Republic of Kazakhstan for construction and housing and communal services in the procedure established by the legislation to provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-chairman of the Agency of the Republic of Kazakhstan for construction and housing and communal services D. A. Akimzhanov.

4. This order becomes effective after ten calendar days from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan.

Rules of addressing of real estate objects in the territory of the Republic of Kazakhstan

1. General provisions

1. These rules of addressing of real estate objects (further - Rules) are developed according to the Laws of the Republic of Kazakhstan of January 23, 2001 "About local public administration and self-government in the Republic of Kazakhstan", of January 11, 2007 "About informatization", of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan", of July 26, 2007 "About state registration of the rights to real estate", of April 16, 1997 "About the housing relations", of December 8, 1993 "About the administrative-territorial device of the Republic of Kazakhstan", of July 11, 1997 "About languages in the Republic of Kazakhstan" and determine procedure for addressing of real estate objects in the territory of the Republic of Kazakhstan and establish structure of the address of real estate object.

2. In these rules the following main terms are used:

1) the area - the named town-planning element having the closed borders;

2) the avenue - the pedestrian street or the road limited from two parties to trees, bushes, climbers;

3) names - the proper names appropriated to settlement components, serving for their allocation and recognition;

4) the preliminary address (project number) - the real estate object address appropriated at stage of execution of the preproject documentation before commissioning of the object;

5) administrative and territorial unit - component of system of the administrativnoterritorialny device of the Republic of Kazakhstan according to the List of names of types of administrative and territorial units according to appendix 1 to these rules;

6) primary real estate object - buildings and constructions, and also subjects to special regulation of town-planning regulation;

7) the block - the volume and spatial element of the building independent in the functional relation which can be used as in combination with other elements of the building, and independently;

8) the boulevard - the street or the local road which counter transport flows are divided by forest-park plantings, pedestrian roads;

9) garage - construction for permanent or temporary storage of road transport;

10) the building - the artificial structure consisting from bearing and protecting the designs forming the obligatory land closed amount, depending on functional purpose used for accommodation or stay of people, accomplishment of production processes, placement and storage of material values. The building can have underground part;

11) the prospectus - the road or the street of city value;

12) the settlement is part of compactly populated territory of the republic with population at least 50 people;

13) components of settlements - the street, the avenue, the lane, the boulevard, the residential district and other components specified in the List of names of types of components of settlements according to appendix 2 to these rules;

14) the road - the highways public, the economic highway, the street of the settlement which are subject to the state accounting and representing complex of the engineering constructions intended for movement of vehicles. The road includes one or several carriageways, and also tram ways, sidewalks, roadsides and dividing strips in case of their availability;

15) category of roads - classification of highways throughout or on certain sites depending on settlement traffic load of vehicles;

16) real estate (further - real estate objects) - the parcels of land, buildings, constructions and other property is strong connected with the earth, that is objects which movement without disproportionate damage to their appointment is impossible;

17) complex of real estate objects - set of buildings, constructions, the engineering networks located on the single parcel of land;

18) the attached objects - the certain rooms (group of rooms) which is functionally not connected with the main residential building adjoining lower floors of the main building;

19) the built-in rooms - the rooms of public appointment placed in volume of the main building with the organization of separate entrance;

20) the built-in attached rooms - the rooms having both the part attached to the main building, and built in it;

21) addressing of real estate objects (further - addressing) - determination and reference of real estate object to the settlement according to administrative-territorial division of the Republic of Kazakhstan and component of this settlement with assignment of sequence number of object;

22) the street - the territory intended for traffic circulation and pedestrians, including the two-way carriageway, roadsides, ditches and the strengthening berma;

23) the case - the building and construction entering the single complex representing complex of the buildings and constructions located on one parcel of land and united on functional purpose;

24) secondary real estate object - the residential and non-residential premises which are parts of primary object;

25) category of town-planning element - the integral part of the name of town-planning element characterizing functional town-planning purpose and features of object;

26) construction - artificially created three-dimensional, plane or linear object (land, surface and (or) underground, underwater) having natural or artificial spatial borders and intended for accomplishment of production processes, placement and storage of material values or temporary stay (movement) of people, freights, and also placement (laying, posting) the equipment or communications;

27) the address - the description of location of real estate object containing the following elements: region, settlement, settlement components, primary real estate object, secondary real estate object (in the presence);

28) the automated information system of the state town-planning inventory (further - AIS GGK) - the state system of the quantitative and qualitative indexes including town-planning regulations, the cartographical, statistical and text information characterizing the territory of town-planning, architectural and construction activities for signs of social legal regime of its use, to the level of technical security in parameters and condition of the objects located on it and also climatic conditions and ecological condition;

29) establishing shot of AIS GGK on duty - the geoinformation digital map of the settlement executed in system of coordinates with the put exact borders of the territory of the settlement, administrative areas, residential districts, quarters, streets, buildings, constructions (including transport and engineering infrastructure) and also details the identifying parcels of land and real estate objects, spatial part of primary object as independent object of civil or other law;

30) the information system "Address Register" - the hardware and software intended for creation, accumulating, processing of data on addresses and unification of the address field of the Republic of Kazakhstan;

31) the registration code of the address (further - RKA) is the unique code of the address of real estate object generated by the information system "Address Register";

32) the mansard floor - the floor in garret space which facade is fully or partially educated surface (surfaces) of inclined, broken or curvilinear roof;

33) the draft of the detailed layout (further - PDP) - the town-planning documentation developed for separate parts and functional zones of the city or rural settlement, and if necessary - on all territory of the small city or rural settlement with population to 50 thousand persons. In this case PDP is combined with the master plan. PDP can be developed also on the territories located outside the settlement;

34) quarter - the structural element of building which is not divided by streets/lanes;

35) the onomastichesky commission - the advisory advisory body developing offers on forming of single approach to the name and renaming of geographical objects, streamlining of the uses and accounting of toponymic names, recovery, preserving historical names as component of historical and cultural heritage of the Republic of Kazakhstan;

36) sequence number of object - the object address detail consisting of the sequence of figures with possible addition of capital letter or through sign of fraction of additional whole figures (no more than two signs). At the same time in number pronouns (for example, letter "Ya"), the Kazakh letters of the alphabet are excluded?, І???????) and the letters of difficult pronunciation (which do not have sound), and similar to figures (O, Zh, Z, I, H, C, H, Sh, Shch, Y, Kommersant);

37) the room - the internal isolated part of structure which is separated other adjacent rooms walls without apertures or deaf partitions and having independent exit to the street to the yard, corridor of general of uses or on staircase. Rooms are according to the destination subdivided on residential and non-residential;

38) body of architecture and town planning, including service of the town-planning inventory of appropriate level - the structural division of local executive body financed from the local budget authorized to perform regulation in the sphere of architectural, town-planning and construction activities;

39) premises - the certain room intended and used for permanent residence, including both living space, and the non-residential area of the dwelling;

40) the lane, the drive - the territory providing entrance of vehicles to buildings, organizations, the companies and other subjects to urban, settlement development, settlements;

41) the route, the highway - the road or the street providing long-distance transport communication;
