About some questions of organ and tissue transplantation of the person

Based on parts two and third article 5 of the Law of the Republic of Belarus of March 4, 1997 "About organ and tissue transplantation of the person" in edition of the Law of the Republic of Belarus of January 9, 2007, subitem 9.1 of Item 9 of the Regulations on the Ministry of Health of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 28, 2011 No. 1446 "About some questions of the Ministry of Health and measures for implementation of the Presidential decree of the Republic of Belarus of August 11, 2011 No. 360" the Ministry of Health of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for pronouncement of the conclusion about need of transplantation.

2. Establish the list of the bodies and tissues of the person which are subject to transplantation according to appendix.

3. Recognize invalid:

the resolution of the Ministry of Health of the Republic of Belarus of May 31, 2007 No. 53 "About determination of the list of the bodies and (or) tissues of the person which are subject to transplantation, and approval of the Instruction about procedure for issue of the medical certificate about need of transplantation" (The national register of legal acts of the Republic of Belarus, 2007, No. 147, 8/16617);

the resolution of the Ministry of Health of the Republic of Belarus of August 31, 2007 No. 77 "About entering of amendment into the resolution of the Ministry of Health of the Republic of Belarus of May 31, 2007 No. 53" (The national register of legal acts of the Republic of Belarus, 2007, No. 214, 8/17047);

Item 9 of the resolution of the Ministry of Health of the Republic of Belarus of November 20, 2007 No. 118 "About modification and amendments in some regulatory legal acts of the Ministry of Health of the Republic of Belarus concerning rendering out-patient and polyclinic, stationary and specialized medical care" (The national register of legal acts of the Republic of Belarus, 2007, No. 302, 8/17630).

4. This resolution becomes effective on January 20, 2013.

7. Complex heart - lungs.

8. Conjunctiva.

9. Bones, fragments of bones with kortikalny layer.

10. Bones of the code of skull.

11. Marrow.

12. Lung.

13. Multivisceral complexes (liver - kidney, liver - pochkanadpochechnik - the site of digestive tract, kidney - pancreas).

14. Lower extremity and its fragments.

15. Liver and its parts.

16. Pancreas independently or in complex with other bodies.

17. Kidneys.

18. Cornea.

19. Heart, pericardium.

20. Sclero.

21. Vessels and sites of the vascular course.

The instruction about procedure for pronouncement of the conclusion about need of transplantation

1. This Instruction determines procedure for removal by medical consultation of the state organization of health care of the conclusion about need of transplantation (further - the conclusion).

2. In this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus of March 4, 1997 "About organ and tissue transplantation of the person" are used (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1997, No. 9, Art. 196; National register of legal acts of the Republic of Belarus, 2007, No. 15, 2/1304).

3. The conclusion is taken out in the state organizations of health care having the right in the procedure established by the legislation of the Republic of Belarus to perform transplantation.

4. The basis for consideration by medical consultation of need of transplantation is such condition of the patient which demonstrates that by any other methods of delivery of health care it is impossible to keep life of the patient or to recover his health.

5. The medical consultation for pronouncement of the conclusion is carried out according to requirements of part two of article 5 of the Law of the Republic of Belarus "About organ and tissue transplantation of the person" and according to the procedure, the established Instruction about procedure for carrying out medical consultations (consultations) approved by the resolution of the Ministry of Health of the Republic of Belarus of December 20, 2008 No. 224 "About approval of the Instruction about procedure for carrying out medical consultations (consultations) and recognition No. 34 which voided resolutions of the Ministry of Health of the Republic of Belarus of June 21, 2002" (The national register of legal acts of the Republic of Belarus, 2009, No. 17, 8/20181).

6. In case of establishment the medical consultation of need of transplantation constitutes the conclusion in form according to appendix to this Instruction.

The conclusion is introduced in medical documents of the recipient and stored in the state organization of health care which medical consultation takes out this conclusion.

The statement from medical documents according to the procedure and terms, stipulated in Item 7.9 lists of the ministerial procedures performed by state bodies and other organizations for petitions from citizens, No. 200 approved by the Presidential decree of the Republic of Belarus of April 26, 2010 "About the ministerial procedures performed by state bodies and other organizations for petitions from citizens" is issued to the recipient (The national register of legal acts of the Republic of Belarus, 2010, No. 119, 1/11590).

7. The information about him in writing within one day from the moment of pronouncement of this conclusion is transferred by the state organization of health care which medical consultation takes out the conclusion to the Republican center of organ and tissue transplantation based on State Healthcare Institution "9th city clinical hospital" for further coordination of activities for optimum matching of couples the donor - the recipient.
