About approval of Administrative regulations of Federal Air Transport Agency of provision of the state service in licensing of transportations by air transport of freights

According to item 4 of Rules of development and approval of administrative regulations of provision of the state services approved by the order of the Government of the Russian Federation of May 16, 2011 N 373 (The Russian Federation Code, N 22, Art. 3169; N 35, of Art. 5092; 2012, N 28, to the Art. 3908), I order:

1. Approve the enclosed Administrative regulations of Federal Air Transport Agency of provision of the state service in licensing of transportations by air transport of freights.

2. Declare invalid the order of the Ministry of Transport of the Russian Federation of January 31, 2011 N 31 "About approval of Administrative regulations of Federal Air Transport Agency on execution of the state function on licensing of transportations by air transport of freights" (it is registered by the Ministry of Justice of the Russian Federation on March 17, 2011, registration N 20163).

Administrative regulations of Federal Air Transport Agency of provision of the state service in licensing of transportations by air transport of freights

I. General provisions

Subject of regulation of regulations

1. The administrative regulations of Federal Air Transport Agency of provision of the state service in licensing of transportations by air transport of freights (further - Regulations) determine terms and the sequence of actions (ministerial procedures) by provision of the state service in licensing of activities for transportations by air transport of freights, except for case if the specified activities are performed for ensuring own needs of the legal entity or the individual entrepreneur (further - the state service).

2. The state service is provided to the legal entities or individual entrepreneurs having the aircraft on the property right, under lease or on other legal cause, the transportations of Rosaviatsia using the specified aircraft for flights and having the air operator certificate, addressed to Management of regulation (further - Management) with the statement for provision of the license for implementation of specific type of activity (further - license applicants, licensees).

As the applicant on behalf of the legal entity or the individual entrepreneur the authorized person which is acting on the basis of the documents confirming its appropriate authority can act.

4. On the official site of Rosaviatsia, and also in the federal state information system "Single Portal of the State and Municipal Services (Functions)" www.gosuslugi.ru in open entry the following information on provision of the state service is placed:

extraction from the legislative and other regulatory legal acts containing the regulations regulating activities for provision of the state service;

working schedule of Management;

the text of these Regulations with appendices;

list of the documents necessary for provision of the state service;

models of document creation, necessary for provision of the state service;

table of terms of provision of the state service and maximum completion dates of separate ministerial procedures;

the refusal bases in provision of the license;

procedure for informing on the course of provision of the state service;

procedure for receipt of consultations;

procedure for appeal of decisions, actions (failure to act) of the officials providing the state service.

5. Consultation on questions of provision of the state service can be performed in oral form - by phone or in case of personal acceptance, in writing.

6. When implementing consultation in oral form officials of Management provide the following information:

about the entering number at which the statement and documents attached to it on licensing is registered in system of clerical work of Management;

about the made decision according to the specific statement;

about regulatory legal acts concerning licensing (the name, date, number of regulatory legal act);

about placement on the official site of Rosaviatsia of information from the register of licenses, and also reference materials concerning licensing.

7. Other information is provided only based on the corresponding written request.

Time of conversation shall not exceed 10 minutes.

8. According to written addresses the answer to the address goes by mail to the applicant in time, not exceeding 30 days from the moment of registration of the written address.

9. If required information cannot be provided without disclosure of the data which are the state or protected by the Federal Law other secret, is reported to the license applicant or the licensee about impossibility to give the pertinent answer of the question posed in connection with inadmissibility of disclosure of data.

12. Provisions of the state service are result:

provision of the duplicate of the license and (or) copy of the license;

refusal in provision of the license;

renewal of the license;

refusal in renewal of the license;

suspension of action of the license;

renewal of action of the license;

cancellation of the license;

cancellation of the license;

the paragraph the eleventh ceased to be valid according to the Order of the Ministry of Transport of the Russian Federation of 31.03.2017 No. 132

provision of data from the register of licenses.

Term of provision of the state service

13. Rosaviatsia makes the decision on provision or on refusal in provision of the license in time, not exceeding 45 days from the date of revenues to consideration of properly issued application for provision of the license.

Terms of passing of the ministerial procedures necessary for provision of the state service are determined according to these Regulations in relation to each ministerial procedure.

Renewal of the license is performed within five days from the date of receipt by Rosaviatsia of the statement for renewal of the license.

The term of provision of the statement from the register of licenses about the specific licensee cannot exceed five working days from the date of receipt of the corresponding statement in Rosaviatsia.

In case of need Rosaviatsia issues the verified copy of the license based on the written application of the licensee within three working days from the date of receipt of the statement.

In case of loss Rosaviatsia grants licenses its duplicate based on the written application of the licensee within three working days from the moment of receipt of the statement.
