According to item 4 of the Rules of provision and use of the dwelling from the state housing stock or the dwelling leased by local executive body in private housing stock approved by the order of the Government of the Republic of Kazakhstan of December 1, 2011 No. 1420 of PRIKAZYVAYU:

1. Approve the enclosed Standard regulations on the housing commissions of local executive bodies, the state companies, public institutions.

2. To provide to department of housing official publication of this order after its state registration in the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the Vice-chairman of the Agency of the Republic of Kazakhstan for construction and housing and communal services Tikhonyuk N. P.

4. This order becomes effective after ten calendar days after day of its first official publication.

Standard regulations on the housing commissions of local executive bodies, state companies, public institutions

1. General provisions

1. The housing commissions of local executive bodies, the state companies, public institutions (further - the Housing commission) are the collegiate organs created under local executive bodies, the state companies, public institutions, authorized on pronouncement of decisions on housing questions, acting on the permanent basis.

2. Authorized body is the local executive body, the state company, the public institution providing the dwelling (further - authorized body).

3. The housing commission is created of odd quantity at least five (in the central state bodies at least seven) the person, including representatives of the trade-union organizations (in the presence), representatives of authorized body and the secretary of the Housing commission.

4. Are part of the Housing commission:

first head of authorized body (except for central state bodies);

chief of staff or deputy first heads of authorized body;

head of legal service (in the presence);

head of financial service;

head of the HR department (personnel service);

secretary of the Housing commission;

representatives of the trade-union organizations no more than three (in the presence);

representatives of authorized body.

5. The housing commission is headed by the first head of authorized body.

In the central state bodies the Housing commission is headed by the chief of staff or the deputy first head of authorized body.

2. Tasks and functions of the Housing commission

6. The main objective of the Housing commission is adoption of the legal decision about provision of the dwelling from the state housing stock or the dwelling leased by local executive body in private housing stock, or privatization of dwellings from the state housing stock.

7. Functions of the Housing commission are:

1) ensuring timely consideration of the applications of the applicants who addressed for obtaining in employment (sublease), acquisition to property of dwellings according to the procedure of privatization or exchange of the dwelling which is earlier provided in employment (sublease) (further - applicants);

2) verification of the documents submitted by the applicant;

3) consideration of the documents submitted by the applicant;

4) decision making about allowance of the application of the applicant, or removal of motivated refusal to the applicant;

5) consideration of question of the conclusion of the employment contract (subhiring) of the dwelling;

6) consideration of question of the conclusion of the agreement on privatization of the dwelling (for local executive bodies);

7) submission of the invoice for payment of cost of the dwelling in case of its privatization (for local executive bodies);

8) determination of the amount of payment for use of the dwelling from the state housing stock;

9) implementation of the translation of the dwelling, privatizeable, in municipal housing stock (for the central state bodies and the state companies);

10) storage and business management (materials) of applicants;

11) to request information from state bodies and other organizations on applicants and their real estate;

12) to involve representatives of the state bodies and other organizations which did not be part of the commission;

13) to receive explanations from applicants.

3. Organization of activities of the Housing commission

8. The housing commission sits at least once a month, except for the central state bodies which housing commissions sit as required.

10. The decision of the Housing commission is signed by the members of the Housing commission having the right to vote.

11. The secretary of the Housing commission takes the minutes of the Housing commission (further - the protocol). The protocol is signed by all members of the Housing commission.

4. Termination of activities of the Housing commission

16. The housing commission stops the activities in case of liquidation or reorganization of authorized body.
