About approval of Rules of provision to state bodies, legal entities and physical persons of information on customs questions

For the purpose of ensuring execution of subitem 1.1.7 of the Presidential decree of the Azerbaijan Republic of September 15, 2011 "About application of the Law of the Azerbaijan Republic "About approval of the Customs code of the Azerbaijan Republic" the Cabinet of Ministers of the Azerbaijan Republic decides No. 499:

Approve "Rules of provision to state bodies, legal entities and physical persons of information on customs questions" it (is applied).

Rules of provision to state bodies, legal entities and physical persons of information on customs questions

1. General provisions

1.1. These rules are prepared according to Article 8.0.27 of the Customs code of the Azerbaijan Republic (further - the Customs code) and determine procedure for provision to state bodies, legal entities and physical persons of information on customs questions.

1.2. These rules do not extend to information on import and export transactions and other customs questions which is regularly provided by the State Customs Committee of the Azerbaijan Republic (further - Committee) to the relevant state bodies.

1.3. The relevant information and documents relating to it are transferred in cases when investigation of the offenses revealed by customs authorities is included into competence of other law enforcement agencies, to the specified bodies.

1.4. Customs authorities based on requests from other law enforcement agencies transfer to the specified bodies the information about persons which is available for them concerning which proceeedings about administrative offense or criminal case are begun.

2. Methods of receipt of information on customs questions

2.1. Persons can obtain information on customs questions by the following methods:

2.1.1. through the information booths established at entrance to customs authorities or the Internet;

2.1.2. by means of the address to the official of customs authority personally or by phone;

2.1.3. by means of representation of the written request to customs authority personally, by means of mail, the telefax, e-mail;

2.1.4. by means of registration as the user of electronic information system of customs authorities.

2.2. In the information booths established at entrance to customs authorities and the following information is posted on the official website of Committee:

2.2.1. number of the hot line of Committee;

2.2.2. names and contact information of customs authorities (postal address, e-mail address, phone numbers and so forth);

2.2.3. regulations on structural divisions of customs authorities;

2.2.4. the instructions developed in connection with activities of customs authorities;

2.2.5. staff lists of customs authorities, names, surnames, phone numbers, e-mail addresses, the officials working in these bodies and also data on their education and specialty;

2.2.6. activities reports of customs authorities;

2.2.7. projects of regulatory legal acts - from the moment of sending for approval or confirmation;

2.2.8. from the effective date orders, orders and decisions of Committee;

2.2.9. information on vacancies of customs authorities;

2.2.10. requirements to giving of requests about provision of information;

2.2.11. excerpts from regulatory legal acts on most frequently asked questions;

2.2.12. the bases for refusal in provision of information;

2.2.13. the list of the provided electronic customs services, and also information on instructions for use these services;

2.2.14. information on the changes connected with the services provided by customs authorities - at least, in ten days prior to modification;

2.2.15. information on reception hours of heads of customs authorities;

2.2.16. payment instructions of work in customs authorities, and also data on rules of provision of additional payments and special privileges;

2.2.17. legal acts, international treaties which party is the Azerbaijan Republic, other regulatory legal acts and classifications in the field of customs affairs;

2.2.18. aggregated statistical data, including the generalized customs statistics of foreign trade of the Azerbaijan Republic;

2.2.19. the list of the data which are the state secret;

2.2.20. data which disclosure is regulated by the special legislation, the international treaties or regulations adopted on their basis;

2.2.21. the innovations connected with customs affairs and activities of customs authorities.

2.3. Information on the changes made to the data specified in Item 2.2 of these rules is published in the printing edition of Committee.

2.4. Changes in legal acts in the field of customs affairs are brought to the attention of the public and by means of other mass media.

2.5. Informing is by phone performed by means of "the hot line" of Committee or on direct office number of the official of customs authority.

2.6. Persons can obtain information on the following spheres of customs affairs on "the hot line" of Committee:

2.6.1. on financial questions and customs payments:

2.6.1.1. on vehicles and excise goods;

2.6.1.2. on other goods imported on the republic territory;

2.6.1.3. on customs value;

2.6.1.4. on currency customs control;

2.6.1.5. on tariff regulation;

2.6.1.6. on road taxes;

2.6.1.7. according to allowing forms;

2.6.2. on the organization of customs control:

2.6.2.1. on business volume;

2.6.2.2. on uncommercial turnover;

2.6.2.3. on customs control over passengers;

2.6.2.4. on veterinary, health, phytosanitary and quarantine control;

2.6.3. on the facts of smuggling and customs offense;

2.6.4. on reconciliation of data with other government institutions;

2.6.5. on the organization of work with personnel;

2.6.6. according to claims;

2.6.7. according to letters;

2.6.8. any other information connected using the customs legislation.

2.7. Information transmitted through "the hot line" by means of technical means registers in electronic media and is provided to person at its request.

2.8. Information concerning the size of customs payments obtained through "the hot line" is obligatory for customs authorities.

2.9. Person cannot be forced to pay customs payments in the amount of, exceeding the amount about which to him it is reported on "the hot line".

2.10. Persons can also obtain necessary customs information by means of the electronic Customs Services placed on the portal of the electronic government.
