About approval of Rules of use of information systems, information technologies and means of their providing in customs affairs

For the purpose of ensuring execution of subitem 1.2.2 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About approval of the Customs code of the Azerbaijan Republic" of September 15, 2011 the No. 499 Cabinet of Ministers of the Azerbaijan Republic decides:

Approve "Rules of use in customs affairs of information systems, information technologies and means of their providing" it (is applied).

Rules of use in customs affairs of information systems, information technologies and means of their providing

1. General provision

1.1. These rules are prepared according to Articles 33.1 and 36.2 of the Customs Code of the Azerbaijan Republic (further - the Customs code) and determine rules of use in customs affairs of information systems, information technologies and means of their providing, including condition and the rule of forming of information resources of customs authorities, their uses and execution of information.

2. Main requirements to information systems and technologies

2.1. Information systems (further - information systems) in customs affairs shall provide the following:

2.1.1. possibilities of search, collection, processing and storage of customs information resources;

2.1.2. provision to officials of customs authorities within the powers of access to information resources conferred to them, held for use customs authorities;

2.1.3. determination of extent of access as the user to information resources, held for use in customs authorities;

2.1.4. reliability of work and resistance to program and technical malfunctions;

2.1.5. reliability, completeness and timely submission of information obtained by means of system;

2.1.6. integration with other information systems;

2.1.7. expansion and updating of system by updating technical and software and inclusion in it of new elements;

2.1.8. protection of the information resources entering information system.

2.2. Information systems shall promote increase in overall performance.

2.3. The information systems, information technologies and means of their providing developed, acquired by customs authorities are in state-owned property.

2.4. Use by customs authorities of the information systems which are not in their use, information technologies and means of their providing is performed on contractual basis.

2.5. The data included in the information systems processed and which are stored in information systems shall satisfy needs of users for customs affairs.

3. Information systems, information technologies and means of their providing in customs affairs

3.1. Use of information systems, information technologies and means of their providing in customs affairs is performed by means of single automated control system of Customs Service (EAIS).

3.2. Main objective of creation of EAIS is increase in efficiency of Customs Service.

3.3. EAIS consists from

3.3.1. regulatory bases of data;

3.3.2. operational databases;

3.3.3. statistical data;

3.3.4. corporate network of Customs Service;

3.3.5. local networks;

3.3.6. computers, and other network and computing equipment.

3.4. The purpose of creation and development of EAIS is:

3.4.1. development of the technical software of EAIS on the basis of the last achievements in the field of the computer, telecommunication equipment and information technologies development and enhancement of the technical software of EAIS based on the last achievements in the field of the computer and telecommunication equipment and information technologies;

3.4.2. implementation of electronic documents and use of paperless technology of processing of customs papers;

3.4.3. creation of common information space of customs authorities;

3.4.4. creation of the single effective mechanism providing operational information exchange between customs authorities, and also between customs authorities and other state bodies, Authorized Economic Operators, subjects of entrepreneurship;

3.4.5. formalization and standardization of customs procedures, technologies, regulatory legal acts and documents;

3.4.6. creation of control systems and tracking goods in case of the procedures requiring long terms of control on time (the international and internal transit, temporary storage, storage on customs warehouses, free zone, temporary import, temporary export, end use, internal and external conversion of goods);

3.4.7. implementation of full control of registration of conditionally released goods;

3.4.8. reducing time spent for work of reporting nature;

3.4.9. continuous customer service and increase in convenience of contacts of clients with customs authorities.

3.5. EAIS is called:

3.5.1. provide customs authorities and state bodies with information concerning customs affairs including information on customs statistics of foreign trade;

3.5.2. enhance system of organizational and economic management of customs authorities;

3.5.3. automate customs control and customs clearance of goods and vehicles;

3.5.4. provide centralized collection and control of charge of customs payments;

3.5.5. provide assistance to acceleration of crossing of customs border with goods and vehicles;

3.5.6. provide information support of fight against smuggling and customs offenses;

3.5.7. provide automated management of risks in the field of customs affairs.

4. Forming and use of information resources of customs authorities

4.1. Information resources of customs authorities are created on the basis of the documents and data represented to customs authorities by persons when making customs transactions according to the Customs Code and other legal acts.

4.2. Information resources are property of the state.

4.3. Information resources are created and used on the basis of the following basic principles:

4.3.1. reliability, accuracy and completeness of information;

4.3.2. timely provision of information;

4.3.3. ensuring information security;

4.3.4. protection of legitimate rights and interests of persons;

4.3.5. ensuring activities of customs authorities.

4.4. The data created by customs authorities it is used only for the customs purposes.

4.5. Information resources are created and used when implementing the following procedures and engineering procedures:
