About approval of Instructions for use electronic information system of customs authorities

For the purpose of ensuring execution of subitem 1.2.3 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About approval of the Customs code of the Azerbaijan Republic" of September 15, 2011 the No. 499 Cabinet of Ministers of the Azerbaijan Republic decides:

Approve "Instructions for use by electronic information system of customs authorities" (are applied).

Instructions for use electronic information system of customs authorities

1. General provisions

1.1. These rules are prepared according to Article 42.2 of the Customs code of the Azerbaijan Republic (further - the Customs code) and determine:

1.1.1. instructions for use electronic information system of customs authorities;

1.1.2 content, representation terms, questions of protection of the customs authorities of data registered in electronic information system;

1.1.3. electronic document management between customs authorities and state bodies, Authorized Economic Operators, subjects of entrepreneurship, and also between customs authorities;

1.1.4. procedure for confirmation of persons as users of electronic information system of customs authorities, the list of documents necessary for this purpose;

1.1.5. reasons for satisfaction of the address of person wishing to become the user of electronic information system of customs authorities;

1.1.6. conditions, for the user, group of users or for all users.

2. Content, representation terms, questions of protection of the customs authorities of data registered in electronic information system

2.1. The data registered in electronic information system of customs authorities cover:

2.1.1. customs clearance and customs control of goods and vehicles;

2.1.2. information support of customs affairs;

2.1.3. the legislation of the State Customs Committee (further - Committee).

2.2. The customs clearance and customs control of goods and vehicles cover:

2.2.1. data on movement of goods and vehicles through customs border of the Azerbaijan Republic (further - customs border);

2.2.2. data on the goods delivery and vehicles in customs authority of appointment;

2.2.3. declaration of goods and vehicles in customs authority;

2.2.4. control of the accuracy of the information containing in the customs declaration;

2.2.5. data on completion of customs clearance.

2.3. The database about the goods and vehicles moved through customs border is created by customs authorities in real time on check points of frontier.

2.4. Data on the goods delivery and vehicles in customs authority of appointment join system in real time customs authorities of appointment.

2.5. For declaration of goods and vehicles in customs authority of appointment the customs applicant, having connected to electronic information system of customs authorities, fills in in real time the electronic customs declaration.

2.6. Customs payments, necessary for registration, are made through bank, mail or plastic credit card, and data on paid amounts are transferred in real time to electronic information system of customs authorities.

2.7. Control of the accuracy of the information containing in the customs declaration is performed by officials of customs authorities and is reflected in system in real time.

2.8. Results of customs control are registered in system in real time, goods and vehicles go for release or are late for application of forms of customs control.

2.9. Data on information support of customs affairs are subdivided into three groups:

2.9.1. legal;

2.9.2. methodical;

2.9.3. organizational.

2.10. Legal support of customs affairs consists of the customs legislation. These data join in electronic information system of customs authorities of regulatory legal acts.

2.11. Methodical providing customs affairs consists of creation of conditions for providing by means of system of customs clearance and customs control and work of customs authorities in single procedure according to the analysis of their results and receipts of access in real time to rules of work of all customs authorities.

2.12. Organizational support of customs affairs assumes creation of conditions from the point of view of possibility of implementation and efficiency of customs clearance and customs control (including electronically).

2.13. Questions of ensuring activities of Committee include:

2.13.1. material logistics of customs authorities;

2.13.2. financial and economic questions of Committee;

2.13.3. work with personnel.

2.14. Work with the data connected with ensuring activities of Committee is carried out according to requirement in real time.

2.15. For information security the following measures shall be taken:

2.15.1. prevention of unauthorized information access and transfer to her faces which do not have the right to access to such information;

2.15.2. timely detection and prevention of unauthorized information access;

2.15.3. prevention of effects of violation of procedure for information access;

2.15.4. non-admission of impact on technical means of information processing as a result of which their functioning is broken;

2.15.5. possibility of immediate recovery of the information modified or destroyed owing to unauthorized access to it;

2.15.6. information security of limited access;

2.15.7. realization of the right to information access;

2.15.8. constant control behind ensuring level of security of information.

2.16. For the purpose of ensuring the protection information access containing in the single automated information system of Customs Service it is performed only by means of the software.

2.17. Protection is provided by means of the following program technical means:

2.17.1. access control in system with provision to users of the rights of users;

2.17.2. obligation of use of digital signatures and cryptographic keys for access to system;

2.17.3. registration of access to the protected information;

2.17.4. control of use of the protected information;

2.17.5. registration of attempts of unauthorized access to system;

2.17.6. processing and transfer with use of means of cryptographic protection of the protected information;

2.17.7. loading and start of the corresponding software on technical means on workplace of each employee of customs which is granted right of access to system;

2.17.8. installation and start of means of information protection.

2.18. For protection of system the following organizational measures are taken:
