About approval of Rules of conducting monitoring, accounting and the reporting under carbon units of emissions of greenhouse gases for the purposes of trade

For the purpose of implementation of the subitem 29) article 17 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 PRIKAZYVAYU:

1. Approve the enclosed Rules of conducting monitoring, accounting and the reporting under carbon units of emissions of greenhouse gases for the purposes of trade.

2. To direct to department of low-carbon development this order to state registration in the Ministry of Justice of the Republic of Kazakhstan and to provide its official publication.

3. This order becomes effective after thirty calendar days after day of its first official publication.

Rules of conducting monitoring, accounting and the reporting under carbon units of emissions of greenhouse gases for the purposes of trade

Chapter 1. General provisions

1. These rules of conducting monitoring, accounting and reporting under carbon units of emissions of greenhouse gases for the purposes of trade (further – Rules) determine procedure for conducting monitoring, accounting and reporting under carbon units to emissions of greenhouse gases for the purposes of trade in the Republic of Kazakhstan and the operations performed with them and extend the action to assigned amount units, units of quota, unit of internal emission reduction, emission reduction unit, unit of certified emission reductions and unit of absorption.

2. In these rules the following determinations are used:

1) the accounting period - calendar year on which the operator of the installation falling under requirements for quoting of emissions of greenhouse gases in the Republic of Kazakhstan provides the reporting under inventory count of greenhouse gases;

2) repayment of quotas for emissions of greenhouse gases – annual retirement (write-off) of carbon units of the National plan of the distribution of quotas for emissions of greenhouse gases approved for the corresponding period, according to the inventory report of emissions of greenhouse gases for accounting year, performed in the State register of carbon units;

3) accounting of carbon units - accounting of information on the carbon units introduced into circulation by the Republic of Kazakhstan and also the transactions with carbon units made in the state register of carbon units;

4) the cancelled carbon units - the carbon units which are completely withdrawn from circulation;

5) the international carbon units - assigned amount units, emission reduction units, units of certified emission reduction, unit of absorption and others carbon units, derivative of them.

3. Monitoring of the international carbon units and operations performed with them through the state register of carbon units is implemented within transactions on their approval by the international register of transactions, and also the procedures which are carried out according to the requirements established within the Kyoto protocol to the Framework Convention of the United Nations on climate change.

Chapter 2. Procedure for conducting monitoring on carbon units of emissions of greenhouse gases

4. On carbon units of emissions of greenhouse gases and the operations performed with them through the state register of carbon units are performed internal and external monitoring.

5. Internal monitoring of carbon units of emissions of greenhouse gases is carried out by the Operator of the state register of carbon units of the Republic of Kazakhstan by means of automatic check of the operations performed with them.

6. External monitoring of carbon units of emissions of greenhouse gases and the operations performed with them will be organized by authorized body in the field of environmental protection with attraction to its carrying out the international experts and accredited bodies on validation and verification.

Chapter 3. Accounting treatment on carbon units of emissions of greenhouse gases

7. Accounting on carbon units of emissions of greenhouse gases is performed in the Republic of Kazakhstan through the state register of carbon units.

8. The operator of the state register of carbon units to each carbon unit of emissions of greenhouse gases assigns unique identification number.

9. For the purpose of separate accounting of the carbon units of emissions of greenhouse gases by the operator of the state register of carbon units entered and withdrawn from circulation by the Republic of Kazakhstan transactions by the following types of accounts open and serviced:

1) account of release of units of quotas;

2) account of cancellation of carbon units;

3) account of repayment of quotas;

4) the provision account of amount of quotas of the National plan of distribution of quotas for emissions of greenhouse gases including also following sub-accounts:

sub-account of distribution of quotas for emissions of greenhouse gases for new installations;

sub-account of issue of additional quotas in cases, stipulated in Item 1 article 94-4 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 (further – the Code);

sub-account of distribution of quotas for emissions of greenhouse gases for installations of subjects of administration which operation during action of the National plan of distribution of quotas for emissions of greenhouse gases falls under requirements of Item 1 of article 94-2 of the Code;

sub-account of issue of carbon units for internal projects on emission reduction of greenhouse gases and (or) increase in absorption of greenhouse gases;

sub-account of sale of quotas on the terms of auction;

5) accounts of operators of installations;

6) accounts of the applicant of internal projects on emission reduction and (or) increase in absorption of greenhouse gases (further - accounts of the applicant of projects);

7) account of operator of the state register.";

10. Accounting of units settled on the basis of the verified reports submitted by operators of installations annually is carried out by the operator of the state register.

Chapter 4. Procedure for the reporting under carbon units of emissions of greenhouse gases

11. The operator of the state register of carbon units provides in authorized body in the field of environmental protection reports on carbon units of emissions of greenhouse gases and the performed operations with them quarterly.

12. Reports of operator of the state register of carbon units on carbon units of emissions of greenhouse gases include the following information:

1) account numbers;
