About some questions of functioning of system of fire-proof regulation and standardization

Based on article 8 of the Law of the Republic of Belarus of June 15, 1993 "About fire safety" and subitem 7.4 of Item 7 of the Regulations on the Ministry of Emergency Situations of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 29, 2006 No. 756 "About some questions of the Ministry of Emergency Situations" the Ministry of Emergency Situations of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for functioning of system of fire-proof regulation and standardization.

2. Recognize invalid:

the resolution of the Ministry of Emergency Situations of the Republic of Belarus of November 25, 2002 No. 27 "About approval of the Instruction for functioning of system of fire-proof regulation and standardization" (The national register of legal acts of the Republic of Belarus, 2002, No. 139, 8/8837);

Item 2 of the resolution of the Ministry of Emergency Situations of the Republic of Belarus of November 12, 2007 No. 99 "About modification and amendments in resolutions of the Ministry of Emergency Situations of the Republic of Belarus of August 16, 2000 No. 19 and of November 25, 2002 No. 27" (The national register of legal acts of the Republic of Belarus, 2007, No. 289, 8/17503).

3. This resolution becomes effective after its official publication.

The instruction about procedure for functioning of system of fire-proof regulation and standardization

1. This Instruction determines procedure for functioning of system of fire-proof regulation and standardization.

2. Requirements of this Instruction are obligatory in case of development of technical regulatory legal acts of system of fire-proof regulation and standardization (further - TNPA) the republican state bodies and other state organizations subordinated to the Government of the Republic of Belarus.

3. Requirements for ensuring fire safety are provided in technical regulatory legal acts and form system of fire-proof regulation and standardization.

4. The list of the technical regulatory legal acts and their structural elements forming system of fire-proof regulation and standardization affirms the Chief state fire supervision inspector of the Republic of Belarus and is posted on the official site of the Ministry of Emergency Situations of the Republic of Belarus.

The TNPA projects, and also the changes made to them and additions are subject to coordination with the Chief state inspector of the Republic of Belarus on fire supervision.

5. TNPA shall correspond to the following conditions:

5.1. fire-proof requirements shall concern only the subject of standardization (regulation) specified in TNPA;

5.2. not contain the fire-proof requirements to object of regulation (standardization) established in other TNPA;

5.3. not contain contradictions with fire-proof requirements of other TNPA;

5.4. the same terms in TNPA shall be used in one value and have the single form;

5.5. fire-proof requirements shall be clear and unambiguous, laconic, mainly affirmative and in the present;

5.6. identical and similar concepts and symbols are not applied to designation of different indicators and characteristics of fire safety;

5.7. fire-proof requirements in TNPA are, as a rule, stated in separate Sections (Chapters).

6. By consideration and coordination of the TNPA projects the materials characterizing fire risk of subjects of standardization (regulation) and (or) proving the fire-proof requirements established on them can be requested from their developers.

7. TNPA can be suspended by the Chief state fire supervision inspector of the Republic of Belarus.

8. The bases for suspension of action of TNPA are:

8.1. lack of coordination with bodies of the state fire supervision;

8.2. contradiction to requirements of fire safety.

9. In case of identification of the bases specified in Item 8 of this Instruction, the Chief state fire supervision inspector of the Republic of Belarus sends to body (official), approved TNPA, the instruction about elimination of the revealed shortcomings (modification and (or) amendments, cancellation) to TNPA.
