DECISION OF BOARD OF THE EURASIAN ECONOMIC COMMISSION

of August 16, 2012 No. 134

About regulatory legal acts in the field of non-tariff regulation

The board of the Euroasian economic commission decided:

1. Approve:

The single inventory to which prohibitions or import restrictions or export by state members of the Customs union within Eurasian economic community in trade with the third countries (appendix No. 1) are applied;

Regulations on application of restrictions (appendix No. 2).

2. Make changes to separate Decisions of the Commission of the Customs union and Board of the Eurasian economic commission according to appendix No. 3.

3. Recognize invalid Decisions of the Commission of the Customs union and Board of the Eurasian economic commission according to appendix No. 4.

4. Determine that export licenses or import and other allowing documents for the export or commodity importation issued by authorized state bodies of state members of the Customs union before entry into force of this Decision are valid before the termination of term of their action.

5. From the effective date this Decision the Single inventory to which prohibitions or import restrictions or export by state members of the Customs union within Eurasian economic community in trade with the third countries are applied and the Regulations on application of restrictions approved by Mezhgossovet's Decision of EurAsEC (The Supreme body of the Customs union) of November 27, 2009 No. 19 "On single non-tariff regulation of the Customs union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation" are not applied.

6. Approve the draft decision of Council of the Eurasian economic commission "About modification of Mezhgossovet's Decision of EurAsEC (The Supreme body of the Customs union) of November 27, 2009 No. 19" (appendix No. 5) and to bring it for consideration at the regular meeting of Council of the Eurasian economic commission.

7. This Decision becomes effective after thirty calendar days from the date of its official publication.

Regulations on application of restrictions

Regulations on procedure for import to customs area of the Customs union and export from customs area of the Customs union of ozone-depleting substances and products containing them

1. The regulations on procedure for import to customs area of the Customs union and export from customs area of the Customs union of ozone-depleting substances and products containing them (further - the Provision) are developed according to the Agreement on rules of licensing in the field of foreign trade in goods of June 9, 2009 (further - the Agreement) and the Agreement on procedure for introduction and application of the measures affecting foreign trade in goods on single customs area concerning the third countries of June 9, 2009.

2. The provision extends to the legal entities and physical persons registered as the subjects of business activity performing import and export of ozone-depleting substances and containing them products specified in Sections 1.1 and 2.1 of the Single inventory to which prohibitions or import restrictions or export by state members of the Customs union within Eurasian economic community in trade with the third countries are applied (further - applicants) and also on the physical persons performing import and/or export of such goods for private use.

3. Import and export of ozone-depleting substances and products containing them from the states and to the states which are the Parties of the Montreal protocol on the substances destroying ozone layer of September 16, 1987, except for their transit transportations through state members of the Customs union is performed based on the licenses granted by authorized state body of state member of the Customs union in the territory of which the applicant is registered (further - authorized body).
